Before merging commune-level administrative units, Ms. Pham Thi Oanh (character's name has been changed) worked at the District Party Committee, receiving an allowance of 55%, of which 30% was Party allowance and 25% was public service.
Currently, after the merger of communes, she holds the position of Vice Chairman of the People's Council of the commune. According to regulations, in the first 6 months after the merger, cadres will still keep their salary and allowances unchanged.
"So will I receive 55% of the allowance like in the district?" - Ms. Oanh asked.
Regarding Ms. Oanh's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
According to Clause 4, Article 11 of Resolution No. 76/2025/UBTVQH15 dated April 14, 2025 of the National Assembly Standing Committee on the arrangement of administrative units in 2025, it is stipulated that: Maintain the current regime, salary policy and position allowances (if any) of cadres, civil servants and public employees affected by the arrangement of administrative units who are still cadres, civil servants and public employees at agencies and organizations in the political system for 6 months from the date of the work arrangement document. After this period, the regime, policies and position allowances will be implemented according to the provisions of law.
At the same time, the Steering Committee for the arrangement of administrative units at all levels and the development of a model for the organization of local government at both levels has issued guiding documents, specifically in Document No. 03/CV-BCD dated April 15, 2025, guiding: Cadres, civil servants, public employees, and workers receiving salaries from the state budget when assigned to work in the new administrative unit will continue to receive salaries according to the rank, level and current salary allowance regimes for 6 months and then implement according to the new regulations of the Government.
In addition, in document No. 11/CV-BCD dated June 4, 2025, it is instructed: Cadres, civil servants, and public employees at the provincial and district levels and current cadres and public employees at the commune level who are currently arranged as civil servants at the new commune level will continue to receive salaries according to their ranks, levels, and current allowance regimes for the next 6 months, then implement according to the new regulations of the Government.
Accordingly, the Ministry of Home Affairs proposes to maintain the allowance regimes according to the above documents.
