On December 28, according to the Government Office, Decree 169 clearly stated that the organizational structure of the Ward People's Committee is implemented according to the provisions of Point a, Clause 3, Article 13 of the Capital Law.
Accordingly, the Ward People's Committee includes: Chairman, Vice Chairman and other civil servants of the ward. Wards of type I and type II have no more than 2 Vice Chairmen of the People's Committee, ward of type III has 1 Vice Chairman of the People's Committee.
The Chairman and Vice Chairman of the Ward People's Committee are civil servants holding leadership and management positions of the Ward People's Committee.
Other civil servants of the Ward People's Committee include: Commander of the Military Command; Office - statistics; Land - construction - urban and environment; Finance - accounting; Justice - civil status; Culture - society.
According to the Decree, the Ward People's Committee operates under the headship regime, ensuring the principle of democratic centralism. The Chairman of the Ward People's Committee decides on matters within the duties and powers of the Ward People's Committee and the Chairman of the Ward People's Committee and is responsible for his/her decisions.
In case of vacancy of the Chairman of the Ward People's Committee, the Chairman of the District, Town or City People's Committee of Hanoi City shall decide to assign the authority of the Chairman of the Ward People's Committee until a decision is made to appoint the Chairman of the Ward People's Committee.
The specific tasks and powers of the Ward People's Committee and the tasks and powers of the Ward People's Committee that are decentralized and authorized as prescribed in Clause 1, Article 13 and Article 14 of the Law on the Capital must be discussed collectively before the Chairman of the Ward People's Committee decides and is responsible for his/her decision.
The collective specified in this clause includes: Chairman of the Ward People's Committee, Vice Chairman of the Ward People's Committee and other relevant civil servants.
The activities of the Ward People's Committee must satisfy the people, comply with procedures, within assigned authority, in accordance with the provisions of law and the Working Regulations of the Ward People's Committee.
The ward police chief advises and is under the direction of the ward People's Committee Chairman in performing tasks related to security, order, social safety, fighting and preventing crimes and other violations of the law in the area according to the provisions of law.
According to the Decree, the Chairman of the Ward People's Committee is the head of the Ward People's Committee, responsible for leading, managing and operating all activities of the Ward People's Committee according to the Working Regulations of the Ward People's Committee, ensuring the principle of democratic centralism and compliance with the provisions of law.
The Chairman of the Ward People's Committee issues the Working Regulations of the Ward People's Committee. At the same time, he is responsible to the People's Council, the People's Committee, the Chairman of the People's Committee of the district, town, city under the city and before the law for the implementation of the tasks and powers of the Ward People's Committee.
The Chairman of the Ward People's Committee directly employs and manages civil servants working at the Ward People's Committee according to the provisions of the Law on the Capital and according to the decentralization and authorization of the City People's Committee, the Chairman of the City People's Committee; the People's Committee and the Chairman of the People's Committee of districts, towns and cities under the city.
The Chairman of the Ward People's Committee signs documents of the Ward People's Committee with the title of Chairman of the Ward People's Committee, head of the state administrative agency in the ward and is responsible for documents of the Ward People's Committee.
The Chairman of the Ward People's Committee who violates the prescribed responsibilities shall be considered for handling according to the provisions of the Law on Cadres and Civil Servants and relevant legal provisions.
This Decree comes into force from January 1, 2025.
