Mr. Nguyen Phi (Vinh Long) is currently working at a provincial level unit and was appointed to a leadership position at a specialized department. Next, Mr. Phi was assigned to concurrently work as a clerk and archiver at the agency.
"I would like to ask about the salary arrangement principles and policies for holding two concurrent positions at the agency, how are they implemented and calculated?" - Mr. Phi wondered.
Regarding the reflection and recommendation of Mr. Nguyen Phi, the Ministry of Home Affairs said: The salary regime for cadres, civil servants and public employees is implemented according to the provisions of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public employees and armed forces and guiding documents.
Article 3 of the Decree clearly states the principles of salary and allowance arrangement for leadership positions, principles of salary payment and implementation of salary regime.
Cadres, civil servants and public employees appointed to any civil servant or public employee rank (hereinafter referred to as rank) or any professional or technical title in the Court or Procuracy sector (hereinafter referred to as title) shall be classified according to that rank or title.
Officials holding elected positions who are subject to professional and technical salary classification and receive leadership position allowances shall be classified according to the administrative civil servant rank and grade and receive leadership position allowances of the elected positions they are currently holding.
Officials, civil servants, and public employees holding leadership positions (elected or appointed) will receive salary or position allowance according to that leadership position. If a person holds many different leadership positions, he/she will receive salary or position allowance according to the highest leadership position. If he/she concurrently holds a leadership position at another agency or unit, and this agency or unit is assigned a full-time head, he/she will receive additional allowance for concurrent positions.
The subjects belonging to the armed forces and the secret service are entitled to receive salary according to the salary table, then their salary is classified according to that salary table.
The conversion of old salaries to new salaries must be associated with the review and arrangement of staffing of agencies and units; the review and completion of standards for titles of cadres, civil servants and public employees; the review of old salary arrangements; in cases where salaries or position allowances have been arranged incorrectly according to regulations of competent agencies, salaries and position allowances (if any) must be re-arranged in accordance with regulations.
The implementation of policies for cadres, civil servants and public employees in Vinh Long province is under the authority of the Provincial People's Committee. Therefore, the Ministry of Home Affairs recommends that Mr. Phi contact the agency managing cadres, civil servants and public employees of Vinh Long province (Department of Home Affairs) for clarification.
