US EB-5 settlement program and possible changes after September 30, 2026

In the 2022 RIA Law, the US government allows EB-5 applications submitted before September 30, 2026 to continue to be processed according to current regulations regardless of whether the program is changed, delayed or suspended afterwards.

This means: Investors only need to submit documents on time to still retain their rights to the visa, investment level and current approval time, and are not affected by future policy adjustments.

There has been no official announcement from the US Department of Immigration (USCIS) about the change to the EB-5 program. However, there are signs that the 5-year-old could enter a completely new phase, such as:

The appearance of the "Gold Card" program worth 5 million USD: At the end of February 2025, President Donald Trump proposed a Golden Card program to replace the current EB-5.

With the deadline of September 30, 2026 clearly established, immigration experts assess that the period from 2025 to early 2026 is the key time for investors to submit EB-5 documents if they want to retain their rights:
