Clause 2, Article 51, Decree 259/2026/ND-CP stipulating the recruitment, use and management of public employees (effective from July 1, 2026) stipulates cases where dismissal has not been resolved as follows:

a) Officials who are under consideration for disciplinary action or are being prosecuted for criminal liability, except for cases according to personal wishes, permitted by competent authorities or according to decisions of competent authorities;

b) Officials who are in the process of resolving complaints and denunciations (who have decided to establish a verification team), inspecting when there are signs of violations, being proposed to handle violations according to inspection and audit conclusions, except in cases according to personal wishes, permitted by competent authorities or according to decisions of competent authorities;

c) Due to work requirements of agencies and organizations or failure to arrange replacements;

d) Other reasons as prescribed by law, according to decisions of competent authorities for dismissal.

Thus, from July 1, 2026, the above cases have not been resolved for civil servants to resign.
