7 rights of social insurance agencies

The Lao Dong Newspaper Legal Consulting Office replied:

Article 17 of the Law on Social Insurance 2024 (effective from July 1, 2025) stipulates the authority of the social insurance agency as follows:

1. Request employers to present labor management books, salary scales, salary tables and information and other documents related to compulsory social insurance, unemployment insurance, and health insurance.

2. The business registration agency, the agency issuing the certificate of operation or the operating license connect, share information or provide a copy of the business license, the certificate of operation or the certificate of business registration, cooperative, or business household to review and check the implementation of registration to participate in compulsory social insurance for newly established enterprises and organizations.

3. The tax authority shall provide information on salary costs to calculate taxes for employers and other information related to social insurance participation according to the provisions of the law on tax management.

4. Resignation to pay compulsory social insurance, voluntary social insurance, unemployment insurance, health insurance when the payment request is not in accordance with the provisions of law; in case of refusal to pay, it must be responded in writing and the reason must be clearly stated.

5. Inspect the implementation of laws on compulsory social insurance, voluntary social insurance, the implementation of contracts for medical examination and treatment under health insurance; payment of unemployment insurance and health insurance. Specialized inspectors on social insurance, unemployment insurance, and health insurance contributions.

6. Propose to competent state agencies to develop, amend and supplement policies and laws on social insurance, unemployment insurance, health insurance and management of social insurance funds, unemployment insurance funds, and health insurance funds.

7. Handling violations of the law or recommending competent state agencies to handle violations of the law on compulsory social insurance, voluntary social insurance, unemployment insurance, and health insurance.

Thus, from July 2025, the rights of social insurance agencies are regulated as above.
