Forms of Vietnam's aid to foreign countries according to new regulations

Lawyer Nguyen Thi Thuy, YouMe Law Firm LLC, replied:

Article 4 of Decree No. 305/2025/ND-CP on Vietnam's aid to foreign countries (effective from November 25, 2025) stipulates the forms and methods of aid as follows:

1. Forms of aid:

a) Construction investment;

b) Technical assistance;

c) Supply of goods;

d) Cash allowance;

d) Other forms as decided by the Prime Minister.

2. Aids:

a) Program;

b) Project;

c) Non-project.

Article 5 of Decree No. 305/2025/ND-CP stipulates the method of implementing aid as follows:

1. The Vietnamese side directly implements programs, projects, and non-projects and transfers the results to the aid recipient.

2. Vietnam transfers money to the aid recipient to self-implement the project, non-project.

3. The application of the method of transferring money from the central budget to the self-receiving party for implementation as prescribed in Clause 2 of this Article must be permitted by competent authorities at the approval step of the list of Reports proposing to provide aid or stated in international treaties and agreements on aid with the aid recipient.

4. Conditions for projects and non-projects to apply the method of transferring money to the aid recipient:

a) Vietnam does not have the conditions to directly implement projects, non-projects to ensure quality, efficiency and safety;

b) Foreign aid projects in cash or interest rate differences.

Thus, from November 25, 2025, the form and method of Vietnam's aid to foreign countries will be implemented according to the above regulations.
