Article 21 of Decree 296/2025/ND-CP regulating the enforcement of decisions on administrative sanctions (effective from January 1, 2026) stipulates that assets that are not subject to seizure include:
1. Property prohibited from circulation according to the provisions of law; assets serving national defense, security, essential goods, public interests; weapons, explosives, support tools; assets containing radioactive substances; fuels, toxins; assets that are relics, antiques, national treasures, documentary heritages according to the provisions of the Law on Cultural Heritage.
2. The following assets of subjects subject to enforcement measures are individuals:
a) The only residence of an individual or a family subject to enforcement measures with a minimum area as prescribed by the law on residence;
b) Medicine, food, and essential needs for individuals subject to enforcement measures and their families;
c) Labor tools and common household items necessary for individuals subject to enforcement measures and their families;
d) objects of worship; relics, medals, medals, certificates of merit;
d) Necessary items for people with disabilities, items used to care for sick people.
3. The following assets of the subjects subject to enforcement measures are the following organizations:
a) Number of medicines for disease prevention and treatment for workers; food, provisions, tools and other assets for workers' meals;
b) Nurseries, schools, medical facilities and other equipment, means, and assets of these facilities, if not assets for business;
c) Equipment, means, and tools to ensure labor safety, fire prevention and fighting, and environmental pollution prevention and control.
4. Property is being mortgaged and mortgaged legally.
Thus, the above assets will not be used for seizure when enforcing the decision to sanction administrative violations.
