Decree 106/2025 of the Government regulating administrative sanctions for violations in the fields of fire prevention, fire fighting and rescue, in which the authority to sanction administrative violations of the People's Public Security is stipulated, effective from July 1, 2025.
Accordingly, People's Public Security soldiers on duty have the right to: Fine warning; Fine up to VND 500,000.
Notably, the head of the commune police, the head of the police station, the head of the police station, the export processing zone, the chief of the International Airport Border Gate, the Battalion Commander
Warning; Fine up to VND 2,500,000; Confiscation of administrative violation exhibits with a value not exceeding 2 times the fine prescribed in Point b of this Clause; Apply remedial measures prescribed in Point a, Clause 1, Article 28 of the Law on Handling of Administrative Violations.
Heads of mobile police units at the company level, station leaders, and team leaders of people specified in Clause 1 of this Article have the right to: Fine warning; Fine up to VND 1,500,000.
Head of Professional Department of the Police Department of Administration on Social Order; Head of Professional Department of Traffic Police Department; Head of Professional Department of the Fire Prevention, Fire and Rescue Police Department; Head of the provincial Police Department includes: Head of Police Department of Administration on Social Order, Head of Traffic Police Department, Head of Fire Prevention and Rescue Police Department, Rescue, Head of Mobile Police Department has the right to:
Warning; Fine up to VND 10,000,000; Revokation of the right to use the license is a document appraising the fire prevention and fighting design, a document approving the acceptance results of fire prevention and fighting;
Confiscation of administrative violation exhibits with a value not exceeding 2 times the fine prescribed in Point b of this Clause; suspension of operations for a period of time; Apply remedial measures prescribed in Clause 3, Article 3 of this Decree.
The Decree also stipulates the authority of the Provincial Police Director, including: Warning fine; Fine up to VND 25,000,000; Confession of the right to use a license as a document appraising the design for fire prevention and fighting, a document approving the results of fire prevention and fighting acceptance;
Confiscate administrative violation exhibits; Suspend operations for a period of time; Apply remedial measures prescribed in Clause 3, Article 3 of this Decree.
