Clause 2, Article 18 of Decree 46/2026/ND-CP detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety (effective from January 26, 2026) stipulates the cases of revocation of certificates of food safety eligibility as follows:
a) Not having a Business Registration Certificate, Enterprise Certificate or Business Registration Certificate, Enterprise Certificate that does not register a suitable food business line or occupation;
b) Within 12 months of being administratively sanctioned 02 or more times for violations of food safety assurance conditions specified in Chapter IV of the Law on Food Safety and legal documents regulating food safety assurance conditions;
c) Using banned substances in the list of banned substances used in food production and business;
d) Producing counterfeit goods that are food, food additives, food processing aids;
e) Within 12 months of 02 or more food poisoning cases or 1 or more food poisoning cases causing death;
e) Dossiers for issuing Certificates of eligibility for food safety establishments using fake documents, fake seals, fake signatures;
g) Using fake test sheets or falsifying test results in quality control and food safety dossiers for the establishment's products;
h) Organizations and individuals who do not notify competent authorities about not operating production and business for 12 months at the location that has been granted a Certificate of eligibility for food safety;
i) At the request of organizations or individuals with a Certificate of eligibility for food safety.
Thus, from January 26, 2026, the certificate of establishment meeting food safety conditions will be revoked in the above case.
