How to recognize the result of dismissal from the position of Village Head?

Clause 3, Article 9 of Decree 59/2023/ND-CP detailing a number of articles of the Law on Implementation of Democracy at the Grassroots level stipulates the recognition of results for dismissal from village heads and residential group leaders as follows:

Within 05 working days from the date of receiving the decision that has been voted on by the residential community, the commune-level People's Committee shall consider and issue a decision recognizing the results of dismissal from the position of Village Head and Residential Group Leader. In case a decision recognizing the results of dismissal from the position of Village Head or Residential Group Leader is not issued, it must be answered in writing and clearly state the reason.

In case the meeting does not agree to dismiss the Village Head and Neighborhood Group Leader, the Commune-level People's Committee shall consider and decide after agreeing with the Commune-level Vietnam Fatherland Front Committee.

Within 60 days from the date of the decision recognizing the resignation of the Village Head and Neighborhood Group Leader, the commune-level People's Committee decides on the election of a new Village Head and Neighborhood Group Leader.

During the time of vacancy for Village Heads and Residential Group Leaders, the People's Committee at the commune level shall agree with the Vietnam Fatherland Front Committee at the commune level to decide to appoint Temporary Village Heads and Residential Group Leaders to manage the activities of villages and residential groups until a new Village Head or Residential Group Leader is elected.

Thus, the recognition of the result of dismissal from the position of Village Head is regulated as above.
