Article 9 of Decree 235/2026/ND-CP on contracts for performing work in public non-business units (effective from July 1, 2026) stipulates the cases of not signing contracts as follows:

1. Not signing contracts for the following cases:

a) People who are officials, civil servants, people working in the armed forces, people working in cryptography; people who have quit their jobs or retired and are subject to contracts not yet signed according to the provisions of law;

b) People who are prohibited from practicing in accordance with the law on the industry and field; people who have conflicts of interest in accordance with the law on anti-corruption;

c) People who do not meet the standards and conditions to provide services according to the provisions of specialized laws;

d) People who are being prosecuted for criminal liability; who are serving or have completed serving sentences or decisions on criminal matters of the Court but have not been expunged from criminal records; who are serving administrative measures at compulsory drug rehabilitation centers, compulsory education centers; people who are incapacitated, limited in civil act capacity or prohibited from doing work related to contract signing;

e) People who are related to spouses, biological fathers, biological mothers; parents (wives or husbands), adoptive fathers, adoptive mothers; biological children, adopted children; brothers, sisters, biological siblings; aunts, uncles, uncles, uncles; brothers, sisters, biological siblings of spouses; wives or husbands of brothers, sisters, biological siblings with competent persons to sign contracts.

2. Failure to sign a contract to perform work related to national security and state secrets in accordance with the law.

Thus, from July 1, 2026, public non-business units will not sign contracts in the above cases.
