Proposal to link civil servant staff with the financial autonomy level of public non-business units

The Ministry of Home Affairs proposes to add new principles on determining and managing the number of people working in public non-business units.

The Ministry of Justice is appraising the draft Decree on management and use of the number of people working in public non-business units, which is being drafted by the Ministry of Home Affairs.

Notably, the draft Decree supplements the principle of determining and managing the number of employees, including:

Strictly implement the Party's regulations and the law on management and use of the number of employees and streamlining staff in public non-business units (DVSNCL).

Ensuring science, objectivity, publicity, transparency, efficiency and improving the quality of the contingent of civil servants in ĐVSNCL.

Determine the number of employees suitable for the job position according to the functions, tasks, powers, and organizational structure of VNU-CLs and the norms for the number of employees according to the guidance of the ministry managing the industry and field; in which, the proportion of employees receiving salaries from career revenues on the total number of employees of VNU-CLs is not lower than the proportion of financial autonomy of VNU-CLs (except in cases where specialized laws have other regulations).

Ensure the correct and effective use of the number of employees assigned by competent authorities.

The Ministry of Home Affairs explained that one of the practical bases is that the determination of civil servant payroll and the number of people working and receiving salaries from career revenue in public service units in the past time has not been implemented uniformly (many units have a high level of financial autonomy but still completely use civil servant payroll receiving salaries from the state budget...) because there are no specific regulations.

Therefore, this Decree needs to specifically stipulate the principle of determining the number of people working and receiving salaries from career revenues in CBs corresponding to the level of financial autonomy of CBs.

The Government's promulgation of a Decree regulating the management and use of the number of people working in VNUs is necessary to institutionalize the Party's regulations on personnel management; stipulating measures to implement policies on managing the number of people working in VNUs.

This Decree will replace the guiding contents on the number of people working in CBs in Decree No. 106/2020/ND-CP (the contents regulating job positions in Decree No. 106/2020/ND-CP continue to be effective until another document replaces it).
