Clause 2, Article 20 of the 2020 Law on Residence, amended and supplemented by Point a, Clause 4, Article 4 of the Law amending and supplementing a number of articles of 10 Laws related to security and order (effective from July 1, 2026), stipulates the conditions for permanent residence registration as follows:
2. A person under 6 years old is allowed to register permanent residence at a legal residence not under their ownership when returning to live with their parents or guardians without the consent of the head of household and the owner of that legal residence.
Citizens are allowed to register permanent residence at a legal residence not under their ownership when agreed upon by the head of household and the owner of that legal residence in the following cases:
a) Wife returns to live with husband; husband returns to live with wife; person from 6 years old or older returns to live with father, mother, guardian; father, mother returns to live with children; person with civil act incapacity, person with difficulty in perception, controlling behavior returns to live with guardian;
b) Elderly people returning to live with their biological brothers, sisters, younger siblings, and nieces; people with particularly severe disabilities, people with severe disabilities, people who are unable to work, people with civil act incapacity, people with difficulty in perceiving and mastering their behavior returning to live with their paternal grandparents, maternal grandparents, maternal grandparents, biological brothers, biological sisters, younger siblings, biological uncles, biological aunts, biological aunts, biological aunts, biological nieces, biological grandchildren;
c) Minors who are agreed by their parents or guardians or no longer have parents to live with their paternal grandparents, maternal grandparents, paternal grandparents, maternal grandparents, maternal grandparents, biological brothers, biological sisters, biological younger siblings, biological uncles, biological uncles, biological aunts, biological aunt, biological aunt
Thus, from July 1, 2026, citizens can register permanent residence at their legal residence not under their ownership in the above cases.
