Article 6, Decree 142/2026/ND-CP detailing a number of articles and measures to implement the Law on Artificial Intelligence (effective from May 1, 2026), stipulates the classification of artificial intelligence systems as follows:
1. The provider is responsible for performing the classification of the artificial intelligence system in accordance with the provisions of Clause 1, Article 10 of the Law on Artificial Intelligence before putting the system into use and is responsible before the law for the accuracy and truthfulness of the classification results.
2. The classification specified in this Article only applies to artificial intelligence systems; does not apply to artificial intelligence models, except in cases where the model is used as a component of a specific artificial intelligence system.
3. The level of risk of artificial intelligence systems is determined as follows:
a) Artificial intelligence systems classified as high-risk are systems belonging to the List of high-risk artificial intelligence systems promulgated by the Prime Minister according to the provisions of Clause 4, Article 13 of the Law on Artificial Intelligence;
b) Artificial intelligence systems classified as having average risk are systems that do not fall into the cases specified in point a of this clause and fall into the cases specified in Article 9 of this Decree;
c) Artificial intelligence systems classified as low-risk are systems that do not fall into the cases specified in points a and b of this clause.
4. In case the implementing party amends, integrates, changes the function or purpose of use of the system compared to the initial announcement of the provider, causing new or higher risks, the implementing party is responsible for coordinating with the provider to review and reclassify the level of risk.
Thus, from May 1, 2026, the artificial intelligence system is classified according to the above regulations.
