According to Point d, Clause 1, Article 23 of the 2019 Law on Militia and Self-Defense Forces, the Chairman of the District People's Committee decides to appoint command positions of the Commune-level Military Command.
Point d, Clause 1, Article 23 is amended by Point b, Clause 11, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates as follows:
dd) The Chairman of the Provincial People's Committee decides to appoint command and assistant positions of the Commune-level Military Command.
In addition, according to Clause 1, Article 19 of the 2019 Law on Militia and Self-Defense Forces, the Commander of the Commune-level Military Command is a command position of the Commune-level Military Command.
Meanwhile, Point b, Clause 2, Article 23 of the 2019 Law on Militia and Self-Defense Forces stipulates: The competent authority that decides to appoint a position has the right to decide to dismiss that position.
Thus, from July 1, 2025, the Chairman of the Provincial People's Committee has the authority to decide to appoint and dismiss the position of Commander of the Commune-level Military Command. Previously, this authority belonged to the Chairman of the District People's Committee.
