Point c, Clause 1, Article 23 of the Law on Militia and Self-Defense Forces 2019, amended by Point a, Clause 11, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates:
The Commander of the Commune-level Military Command decides to appoint the Village team leader, Lieutenant team leader, Sub-captain, Captain and Goal squad leader of the Militia and Self-Defense Forces after receiving the approval of the Chairman of the Commune-level People's Committee and the Commander of the Hanoi Capital Command, the Commander of the Ho Chi Minh City Command, and the Commander of the Provincial Military Command;
Clause 2, Article 23 stipulates as follows:
2. The dismissal of the positions of militia and self-defense commander is regulated as follows:
a) Remove the positions of militia and self-defense forces commanders when changing work positions or changing organizations without the current position or no longer meeting the standards and conditions for performing the current position;
b) The competent authority deciding to appoint a position has the right to decide to dismiss that position.
3. The Minister of National Defense shall prescribe the order and procedures for appointment and dismissal of positions in this Article and the authority to appoint positions of commanding self-defense units in military enterprises; prescribe officers of the Vietnam People's Army to hold the position of commanding the Militia and Self-Defense Forces in case of necessity.
Meanwhile, according to the provisions of Article 18 of the 2019 Law on Militia and Self-Defense Forces (amended by Article 10 of the Law amending 11 Laws on Military and Defense 2025, effective from July 1, 2025), the Village Team Leader belongs to the militia and self-defense command system.
Thus, the Commander of the Commune-level Military Command has the authority to decide to dismiss the Village Team Leader.
