After the restructuring of the apparatus, many localities have questioned the implementation of the salary and allowance regime.
Regarding this content, Deputy Director of the Department of Salary - Social Insurance (Ministry of Home Affairs) Tong Van Lai responded at the professional training conference for commune-level cadres, civil servants and public employees.
Mr. Tong Van Lai said that the National Assembly Standing Committee has issued a resolution, the Prime Minister has issued a decision, the Government Steering Committee also has 2 documents with detailed orientations, many of which are on salary and allowance issues.
These documents clearly state that in the process of restructuring the apparatus, cadres, civil servants, public employees and workers receiving salaries from the budget directly affected will have their current salary and allowance regimes reserved.
Currently, the salary policy is implemented according to Resolution 730 2004 of the National Assembly Standing Committee; Decree 24/2023 regulating the basic salary level and Decision 128 on salary regime for cadres, civil servants, and public employees of agencies and units under the Party, the Front and mass organizations.
Salary policy includes: Salary level according to rank (ie salary coefficient with basic salary); salary increase regime and allowance regime. Documents guided by the National Assembly, the Government and the Steering Committee include all of these contents.
The Deputy Director of the Department of Salary - Social Insurance informed that cadres and civil servants affected by the restructuring of the apparatus will continue to implement the salary regime. Therefore, salary increases for this group are still implemented normally if they meet the prescribed conditions.
Along with salary, there are currently 18 types of allowances, which are the following types of allowances: Leadership position; seniority beyond the framework; concurrently; area; special; attraction; mobile; toxicity, danger; work responsibility; security and defense services; seniority in the profession; professional responsibility; preferential treatment; special allowances for armed forces; long-term work in areas with special difficulties; public service; Party and mass organizations; internal political protection and responsibility for commune-level titles.
"In the spirit of the guiding documents, not all cadres and civil servants are entitled to these allowances. Those who are receiving any of these allowances will continue to receive that allowance when the apparatus is reorganized and their jobs and positions change" - Mr. Tong Van Lai said.
Regarding allowances, according to Mr. Lai, there are 2 types of allowances that are widely applied and have a direct impact on the process of restructuring the apparatus, especially at the commune level. These are regional allowances and special allowances.
Regarding regional allowances, before the organizational arrangement, the whole country had 4,397 communes out of a total of more than 10,000 communes receiving this allowance. The special allowance is applied to 255 out of more than 10,000 communes.
"After rearranging the communes, the State has not yet regulated allowances for these cases because the number is too large and too complicated," said the leader of the Department of Salary and Social Insurance.
The Ministry of Home Affairs has re-numbered and is developing a very specific plan to regulate these two types of allowances after the restructuring of the apparatus.
Mr. Lai said that the Department has reported to the Minister of Home Affairs the options after reviewing and will collect the opinions of 34 provinces and cities. Localities continue to review the above 2 types of allowances to develop new plans. The most suitable allowance level will be proposed to the new commune on the basis of practice and science.
