The Lao Dong Newspaper Legal Consulting Office replied:
Clause 5, Article 36 of the Law on Organization of Local Government 2025 (effective from March 1, 2025) stipulates: People's Council delegates who do not meet the standards of People's Council delegates and are no longer worthy of the trust of the People will be dismissed by the People's Council or voters.
The Standing Committee of the People's Council decides whether to appoint a People's Council to dismiss a People's Council delegate or, at the request of the Vietnam Fatherland Front Committee at the same level, to elect a People's Council delegate to dismiss a People's Council delegate.
In case the People's Council dismisses a People's Council delegate, the dismissal must be approved by at least two-thirds of the total number of People's Council delegates.
The procedure for voters to dismiss People's Council delegates is implemented according to the regulations of the National Assembly Standing Committee.
Thus, from March 2025, the dismissal of People's Council delegates is regulated as above.
