Regulations on converting housing functions

The Lao Dong Newspaper Legal Consulting Office replied:

Article 124 of the 2023 Housing Law stipulates the conversion of housing functions as follows:

1. Cases of housing conversion include:

a) Conversion from resettlement housing to social housing;

b) Conversion from public housing or social housing when no longer needed to housing for resettlement;

c) Converting houses falling under the provisions of Point d, Clause 1, Article 13 of this Law to public housing or social housing for rent;

d) Other cases according to the Prime Minister's decision on the basis of the proposal of the Ministry of Construction.

2. The conversion of housing functions as prescribed in Clause 1 of this Article must comply with the following principles:

a) Must be consistent with the approved provincial housing development program and plan, not causing loss of public assets;

b) After the conversion of functions, the converted house must be used effectively, for the right purpose and in accordance with the standards and technical regulations of the converted house;

c) Must be approved by the Ministry of Construction or the Provincial People's Committee.

3. The Government shall detail this Article.

Thus, the conversion of housing functions is regulated as above.
