Clause 2, Article 51 of the 2025 Law on Employment (effective from January 1, 2026) stipulates complaints and complaint settlement; litigation against decisions and acts on unemployment insurance as follows:
2. Complaints against decisions and acts regarding unemployment insurance are made as follows:
a) When there is a basis to believe that the decision or act on unemployment insurance is illegal, violating their legitimate rights and interests, the first complaenter shall go to the social insurance agency or public employment service organization where the person has the decision or act on unemployment insurance or file a lawsuit in court according to the provisions of law;
b) In case the reclamant does not agree with the results of the first complaint settlement of the social insurance agency or the complaint does not have been resolved within the prescribed time limit, he/she has the right to file a second complaint directly to the head of the superior agency or file a lawsuit in the Court according to the provisions of law.
In case the complainner does not agree with the results of the first complaint settlement of the public employment service organization or the complaint does not have the prescribed time limit and the complaint is not resolved, he/she has the right to make a second complaint to the head of the professional agency on employment of the Provincial People's Committee or file a lawsuit in the Court according to the provisions of law;
c) In case the reclamant does not agree with the decision to resolve the second complaint or the prescribed time limit expires and the complaint is not resolved, he/she has the right to file a lawsuit at the Court in accordance with the provisions of law.
Thus, from January 1, 2026, complaints about unemployment insurance decisions will be made according to the above regulations.
