Lao Dong Newspaper Legal Consulting Office replied:
Clause 2, Article 51, Decree 168/2024/ND-CP (effective from January 1, 2025) stipulates the procedures for restoring driving license points in cases where the driving license has not been fully deducted and has not been deducted within 12 months from the date of the most recent point deduction as follows:
a) When 12 months have passed since the date of the most recent driver's license point deduction, the driver's license point data will be automatically restored to 12 points (including driver's licenses that are currently being revoked) and automatically updated in the Database on handling administrative violations of road traffic order and safety;
b) Immediately after the driving license points data is restored, the Database on handling administrative violations of road traffic order and safety will automatically send notification information to the person whose driving license points are restored to know about the points restoration according to the provisions at Point c of this Clause;
c) Notification of driver's license point restoration is done electronically through the citizen's account registered on the Public Service Portal, Traffic Application on mobile devices; at the same time, information on the driver's license with points restored is updated on the Electronic Information Page of the Traffic Police Department. In case the driver's license is presented in the form of a data message, the driver's license point restoration status is updated in the electronic ID card, electronic identification account on the national identification application.
Thus, the order and procedures for restoring driving license points in cases where the driving license has not been fully deducted points are prescribed as above.
