Procedure for determining the level of disability

Article 18 of the Consolidated Law on Persons with Disabilities 2019 stipulates the procedure for determining the level of disability as follows:

1. When there is a need to determine the level of disability, the disabled person or the legal representative of the disabled person shall submit an application to the People's Committee of the commune where the disabled person resides.

2. Within 30 days from the date of receipt of the application for determination of disability level, the Chairman of the People's Committee at the commune level shall be responsible for convening the Council for determination of disability level and sending a notice of the time for determination of disability level to the disabled person or their legal representative.

3. The Disability Determination Council organizes the determination of the disability level, prepares a record of the disability level determination and makes a conclusion.

4. Within 05 working days from the date of the conclusion of the Council on determining the level of disability, the Chairman of the People's Committee at the commune level shall post and publicly announce the conclusion of the Council on determining the level of disability and issue a certificate of disability.

5. The Minister of Labor, War Invalids and Social Affairs shall detail the procedures and records for determining the level of disability prescribed in this Article.

Thus, the procedure for determining the level of disability is prescribed as above.
