Article 21, Decree 337/2025/ND-CP Regulations on electronic labor contracts (effective from January 1, 2026), stipulates the responsibilities of eContract providers as follows:
1. Send electronic labor contracts with IDs attached to employees and employers in the form of data messages through electronic means in accordance with the service provision agreement.
2. Establishing a stable and secure technical connection channel with the Electronic Labor Contract Platform, ensuring accurate, timely and secure data transmission and receipt capabilities.
3. Publicly announce operating methods and service quality on the official electronic information page of the Provider eContract, including: service registration procedures, forms, related costs and service provision conditions.
4. Ensure continuous connection, security, and integrity of electronic labor contract data; necessary conditions for implementing electronic labor contracts and performing transactions at the request of relevant parties in the conclusion and implementation of electronic labor contracts.
5. Provide tools for employers to digitize and convert forms between paper labor contracts and electronic labor contracts; tools to report labor use situations in accordance with legal regulations.
6. Fully implement the reporting regime on the deployment of eContract provision activities; on the situation of electronic labor contract transactions on eContract according to the regulations of the Ministry of Home Affairs.
7. Implement the storage of electronic labor contract data in accordance with legal regulations on storage.
8. Develop and maintain technical, organizational, personnel and professional procedures to implement the certification of electronic labor contracts.
9. In case the eContract Provider terminates operations, all electronic labor contract data must be transferred to the Electronic Labor Contract Platform according to the guidance of the Ministry of Home Affairs.
Thus, the eContract provider has the same responsibility as above regarding electronic labor contracts.
