Bac Ninh Provincial Inspectorate has just issued a Notice of Inspection Conclusion on the implementation of financial obligations to the State budget; compliance with environmental policies and laws, exploitation of resources of Phuc Thinh Construction and Trading Co., Ltd. (Phuc Thinh Company) in the period from 2023 to the time of inspection.
According to the conclusion, Phuc Thinh Company is the investor of the project to invest in the construction of land reclamation exploitation works in the hot pit area, Huong Than village, Kep commune, Bac Ninh province (formerly Huong Son commune, Lang Giang district, Bac Giang province).
The project is licensed to exploit minerals for ordinary construction materials with an area of 3.7ha, exploitation reserves of 291,729m3, capacity of 97,243m3/year. The exploitation period is until June 21, 2025.
Through inspection, functional agencies determined that in 2025, Phuc Thinh Company exploited 15.5% exceeding the capacity stated in the issued license. The inspection determined that this is an act of violating the right to exploit minerals according to the provisions of Article 73 of the Law on Geology and Minerals in 2024.
Not only exploiting beyond the licensed capacity, Bac Ninh Provincial Inspectorate also pointed out many shortcomings and violations of Phuc Thinh Company in the project implementation process.
Regarding the order and procedures for investment, the enterprise did not organize appraisal of construction drawing designs and construction estimates; did not carry out investment activity reports and investment activity supervision reports as prescribed. Notably, Phuc Thinh Company did not deposit to ensure the implementation of the investment project.
In the field of environment, the company did not have a written notice of the completion results of environmental protection works before putting the project into official operation; and at the same time did not provide dossiers and documents on publicizing the decision to approve the environmental impact assessment report (EIA) and the EIA report after the appraisal results were approved.
For basic construction of mines, enterprises do not organize appraisal of construction items, do not apply for construction permits for project items. The Company also does not construct a 432m long road into the auxiliary area; soil transport vehicles use trails that people have leveled in advance to enter the exploitation area.
During the mining process, Phuc Thinh Company could not store information and data related to the weighing station; could not provide records of camera installation in the mine area and could not store related information and data as prescribed.
Notably, the mineral exploitation license expired on June 21, 2025, but by the time of inspection in May 2026, Phuc Thinh Company had not yet completed the procedures for closing the mine. The inspection determined that not closing the mine when the license expired was an act of violating the mineral law.
Phuc Thinh Company has a charter capital of 50 billion VND, the legal representative is Ms. Vu Thi Ha - Director of the Company; address in Kep commune, Bac Ninh province. The main business lines are road freight transport; sand, gravel, clay mining; building houses of all kinds; wholesale of cars and other engines; wholesale of iron, steel, other metals; wholesale of materials and equipment installed in construction.
