Accordingly, the Chairman of Bac Ninh Provincial People's Committee assigned the Department of Agriculture and Environment to preside over and coordinate with the Department of Justice, relevant agencies and units to focus on reviewing legal documents on the management of licensing activities, exploration and exploitation of minerals, and identifying inadequacies and shortcomings.
Organize review and assessment of the achieved results, shortcomings and limitations of the Coordination Regulation in state management of minerals in Bac Ninh province in the past time and advise the Provincial People's Committee to consider, amend, and supplement the Regulation to be appropriate in the direction of specific and clear assignment, decentralization, and assignment of responsibilities, as a basis for considering and handling responsibilities for organizations and individuals when violations of the law occur in the field of mineral resources.
People's Committees of communes and wards (where there are minerals) perform the responsibility of state management of geology and minerals, responsibility for protecting unexploited mineral resources in the managed area; promptly detect, prevent and strictly handle organizations and individuals violating the law on geology and minerals in accordance with regulations.
In the process of considering and handling violations, if it is found that the violation act shows signs of crime, the competent person handling the case must transfer the file related to the act showing signs of crime to the competent authority conducting criminal proceedings to consider and conclude the case according to the provisions of criminal procedure law.
Departments and relevant agencies are responsible for coordinating with the Department of Agriculture and Environment, People's Committees of communes and wards (where there are minerals) to organize the implementation of assigned tasks; proactively resolve and promptly handle contents related to the field according to their authority, in accordance with the law.
