Sending a question to the Social Insurance agency, reader N.T.P.L said: "Workers take sick leave on August 8-10, 2025 (according to discharge papers, hospitalization from 1:00 PM on August 8, discharge at 11:00 AM on August 10).
I would like to ask, when resolving sickness benefits, is the number of days entitled to benefits 3 days or 1 day 9.8, 1.2 days 8.8 and 1/2 days 10.8? Because according to the Social Insurance Law 2024, there is a half-day sickness payment".
Regarding this issue, Hanoi City Social Insurance answers as follows:
Based on Clause 5, Article 45 of the 2024 Law on Social Insurance, the level of sickness allowance per 1 day is calculated equal to the level of sickness allowance per month divided by 24 days.
The level of sickness allowance for 1/2 day is calculated equal to half of the level of sickness allowance for 1 day. When calculating the level of sickness allowance for employees who take leave to enjoy sickness benefits for a non-full-day period, the case of taking leave for less than 1/2 day is calculated as 1/2 day; from 1/2 day to less than 1 day is calculated as 1 day.
Because Ms. L did not clearly state whether the working hours at the unit were office hours or shifts, according to the provisions of the Labor Code, working hours in the morning: 8 am to 12 pm, and in the afternoon: 1 pm to 5 pm, her case was paid for 2 days according to regulations.
