The Ministry of Home Affairs guides regulations on the time to obtain a university degree when considering receiving civil servants.

Mr. Nguyen Van Viet (name of the character changed) said that the documents regulating the content of civil servant reception only stipulate that non-specialized personnel with a working period of over 5 years are considered for civil servant recruitment, and do not mention the requirement to have a university degree of over 5 years.

Meanwhile, in the reply document of the Ministry of Home Affairs sent to the An Giang Provincial Department of Home Affairs, the condition is that the recipient must have a university degree for more than 5 years. According to Mr. Viet, this regulation makes many cases like him not eligible for admission consideration.

Mr. Viet said that he has worked for more than 10 years and has a corresponding social insurance contribution period of 10 years, and also has a university degree. However, because the university degree was newly issued for about 2 years, it does not meet the condition of "university degree over 5 years", leading to the application not being considered.

Therefore, Mr. Nguyen Van Viet hopes that the Ministry of Home Affairs will study and have appropriate mechanisms to create conditions for non-specialized personnel who have worked for many years like him to be considered for recruitment as civil servants, thereby continuing to contribute to the locality.

Regarding Mr. Viet's feedback and recommendations, the Ministry of Home Affairs has responded on the Electronic Information Portal.

The Ministry of Home Affairs said that Article 67 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government on recruitment, use and management of civil servants stipulates the tasks of the Provincial People's Committee, including the tasks of: Developing a job position project; deciding on the list and number of job positions; managing job positions according to the Party's regulations and the law;

Implementing statistics and statistical reports for civil servants according to regulations; Guiding and inspecting the implementation of legal regulations for civil servants under management.

In addition, the tasks of the Chairman of the Provincial People's Committee are also clearly stated:

Performing the tasks specified in Clause 1, Article 64 of this Decree and according to the decentralization and authorization of the Provincial People's Committee;

Implement or decentralize the implementation of tasks specified in Clause 5, Article 64 of this Decree for civil servants according to the decentralization of management authority;

Organize the implementation of civil servant management contents specified in Clauses 3, 4, 6, 7, 8, Article 64 of this Decree and issue or decentralize, authorize the issuance of corresponding decisions to implement the management of civil servants according to their authority, except for contents under the authority of the agency using civil servants according to the provisions of the Law on Cadres and Civil Servants in 2025.

The Ministry of Home Affairs requested him to exchange with the civil servant recruitment agency for answers.
