Civil servants with 5 years or more of service may be considered for recruitment into civil servants

The Ministry of Home Affairs has just made a new proposal on regulations on 5 years of working experience when receiving civil servants.

The Ministry of Home Affairs is drafting a Government Decree amending and supplementing Decree No. 170/2025 of the Government regulating the recruitment, use and management of civil servants.

In the draft Decree, the Ministry of Home Affairs proposes to amend Article 13 regulating subjects, standards, conditions, and dossiers for receiving civil servant positions.

Receivers include:

a) Experts, scientists, jurists, good lawyers, typical and outstanding entrepreneurs;

b) Public employees;

c) Salaried people in the People's Army, People's Police, cipher organizations who are not civil servants;

d) People holding leadership and management positions and titles from the department level upwards in enterprises where the State holds 100% of charter capital or in enterprises where the State holds over 50% of charter capital or the total number of voting shares; working in agencies, organizations, and units outside the public sector according to the policy of attracting talented people;

e) People who were formerly cadres and civil servants and then were transferred or rotated by competent authorities to hold positions that are not cadres or civil servants at other agencies and organizations;

e) People recruited according to the staffing quota assigned by competent authorities to work in associations assigned tasks by the Party and the State;

g) Non-specialized personnel at the commune level before July 1, 2025;

Standards and conditions for admission:

Based on the proportion of civil servants to be arranged according to each job position in the agency using civil servants, the assigned staff quota and the requirements of the job position to be recruited, the competent authority specified in Clause 2 of this Article decides to receive them to become civil servants for the cases specified in Clause 1 of this Article if they meet the following conditions:

a) Meeting the standards and conditions for registering for civil servant recruitment specified in Clause 1, Article 19 of the Law on Cadres and Civil Servants;

b) Not falling into one of the cases specified in Clause 3, Article 19 of the Law on Cadres and Civil Servants or being in the period of disciplinary action, being in the period of enforcement of disciplinary decisions, being in the period of implementation of regulations related to discipline according to the Party's regulations and the law.

c) In case specified in point a, clause 1 of this Article, there must be results and products suitable for the expected job position to be received.

d) In cases specified in points b, c, d, e, g and h, clause 1 of this Article, they must have 5 years or more of service working on a job requiring professional and nghiệp vụ training suitable for the job position expected to be received;

The working time at this point is the time with compulsory social insurance contributions (if not continuous and has not received a one-time social insurance allowance, it is accumulated, including the working time if it was previously in the position specified in Clause 1 of this Article or in the position of commune-level cadres and civil servants as prescribed in the Law on Cadres and Civil Servants of 2008), excluding probationary time (if any).

h) Team members of the Pilot Project on selecting young intellectuals to volunteer to communes to participate in rural and mountainous development in the period 2013 - 2020 who are signing labor contracts to work in communes.

e) In cases specified in point d, clause 1 of this Article, there must be a written decision from a competent authority deciding to work at other agencies, organizations, and units according to task requirements and not to meet the requirements for a 5-year working period specified in point d of this clause.
