Sending a question to the Ministry of Home Affairs, teacher L.T. H said: "I am a teacher at a public kindergarten continuously from August 1986 to December 2025, the total working time is 39 years, I have not received benefits once. On January 1, 2026, I will retire.
The Social Insurance Agency has finalized my number of years of working with social insurance contributions as from July 1994, and there is no additional support.
I would like to ask, is it appropriate for my case to only count the number of years of social insurance contribution from July 1994 to December 2025?
Regarding this issue, the Ministry of Home Affairs answers as follows:
Currently, the calculation of working time before January 1, 1995 to enjoy social insurance is implemented according to the provisions of Article 141 of the 2024 Law on Social Insurance and Article 34 of Decree No. 158/2025/ND-CP dated June 26, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance.
According to the provisions of the 2024 Law on Social Insurance, the social insurance agency has the function of implementing social insurance regimes and policies, is responsible for resolving the enjoyment of social insurance regimes, determining the time of social insurance contribution for employees; providing complete and timely information on contributions, rights to enjoy regimes, and procedures for implementing social insurance when employees request.
Therefore, it is requested that Ms. L.T. H contact the local social insurance agency for specific information about the contribution period and the right to enjoy social insurance benefits according to the provisions of law.
