Phu Tho voters reflected: Currently, Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Ministry of Construction stipulates the decentralization of construction works and instructions for application in the management of construction investment activities, decentralization of 35kV, 22kV, 10kV, 6kV and 04kV medium and low voltage power works are level IV energy works.
According to the regulations, a level IV project is a project that does not affect public safety, so it is not mandatory to appraise and inspect the acceptance work of the state management agency during the investment and construction process.
However, medium and low voltage power projects all have a great impact on community safety, ensuring a safety corridor for the power grid, therefore, the management of the quality of power project construction is very important and necessary.
Therefore, it is recommended that the Ministry of Construction consider adjusting Circular No. 06/2021/TT-BXD dated June 30, 2021 in the direction of: Decentralizing power line and transformer station works from 0.4kV to 35kV as level III energy works (works affecting public safety) to improve legality, as a basis for state management agencies to inspect and supervise the construction of power works".
After studying, the Ministry of Construction responded as follows:
The decentralization of the "line and transformer station" project in Section 1.1.5.11 Table 1.2 Appendix I of Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction regulating the decentralization of construction works and instructions for application in the management of construction investment activities is based on the proposal of the Ministry of Industry and Trade (documents No. 1449/BCT-KH dated March 17, 2021 and No. 2810/BCT-KH dated May 20, 2021) and implemented according to the content of Resolution No. 02/NQ-CP dated January 1, 2021 of the Government on power development to improve national competitiveness (attached to Resolution No. 02/NQ-CP dated January 1, 2021, Resolution No. 02/NQ-CP dated January 10, 2022).
In addition, for construction works not included in the List of works with a major impact on safety and public benefits as prescribed in Appendix III of Decree No. 144/2025/ND-CP, the management responsibility for construction activities is specifically assigned by the Government as follows:
The provincial People's Committee is fully responsible for managing the construction order of construction works in the area according to the provisions of Clause 8, Article 121 of Decree No. 175/2024/ND-CP.
The People's Committee at the commune level is responsible for managing construction order in the area according to the decentralization of the Provincial People's Committee as prescribed in Clause 9, Article 121 of Decree No. 175/2024/ND-CP.
The investor is responsible for organizing the management of construction works; organizing the management of construction works; organizing the supervision of construction works, acceptance of construction work, construction parts, and items; organizing the handover of works for exploitation and use according to the provisions of Decree No. 06/2021/ND-CP.
Therefore, state management agencies and local construction specialized agencies have sufficient legal basis to conduct inspection and supervision in the construction of power lines and transformer stations from 0.4kV to 35kV.
