In this Circular, the Ministry of Health clearly stated the authority to receive reports on the results of the Month of Action for Children as prescribed in Clause 1, Article 5 of Circular No. 28/2019/TT-BLDTBXH dated December 26, 2019 of the Minister of Labor, War Invalids and Social Affairs guiding the organization of the Month of Action for Children by the Provincial People's Committee.
Implementation procedures: The People's Committee at the commune level shall send a report on the results of the Month of Action for Children to the People's Committee at the provincial level before July 20 every year.
Regarding the authority to receive reports on the results of organizing children's forums as prescribed in Clause 4, Article 14 of Circular No. 29/2019/TT-BLDTBXH dated December 26, 2019 of the Minister of Labor, War Invalids and Social Affairs guiding the organization of children's forums, the Provincial People's Committee shall organize them.
Regarding the implementation procedures, the People's Committee at the commune level will synthesize and report the results of organizing the children's forum to the Provincial People's Committee no later than 15 days from the date of completion of the children's forum.
Regarding the implementation of regulations on alternative care for children, the Ministry of Health stated that in receiving the list and records of children being cared for at facilities in need of alternative care, every 6 months, the head of a social assistance facility is responsible for making a list and records of children being cared for at facilities in need of alternative care and sending them to the Chairman of the Provincial People's Committee, the Chairman of the Commune People's Committee for approval according to management authority to serve as a basis for finding individuals and families receiving alternative care for children;

The Chairman of the People's Committee of the commune where the individual or family registers to receive replacement care is responsible for receiving the list and records of children in need of replacement care transferred by the Chairman of the People's Committee at the provincial level, the Chairman of the People's Committee at the commune level managing social assistance facilities according to the approved authority and assigning the person working in child protection at the commune level to carry out replacement care support activities for children according to regulations.
Regarding the determination of children receiving replacement care, the Ministry of Health clearly states the authority to determine children receiving replacement care as prescribed in Clause 2, Article 5 of Circular No. 14/2020/TT-LDTBXH dated November 28, 2020 of the Minister of Labor, War Invalids and Social Affairs guiding the implementation of regulations on replacement care for children approved by the Chairman of the Provincial People's Committee or the Chairman of the Commune People's Committee under its management authority.
The Ministry of Health also clearly stated the authority to advise individuals and families selected for the list of subjects receiving replacement care prescribed in Clause 3, Article 7 of Circular No. 14/2020/TT-LDTBXH by specialized health agencies under the Provincial People's Committee, Commune People's Committees, and facilities providing child protection services.
Regarding the authority to coordinate the reception of child replacement care as prescribed in Clause 4, Article 7 of Circular No. 14/2020/TT-LDTBXH implemented by the People's Committees at the commune level.
The implementation procedures are as follows: The People's Committees at the commune level review and compile a list of individuals and families who need to receive replacement care;
Monthly information on children and individuals and families receiving replacement care is selected for the People's Committee of the commune where the individual or family needs to receive replacement care for residence to continue to provide replacement care for children according to regulations.
Regarding the authority to receive requests for connection and referral of services for children at the commune level and coordinate and connect to help children access services according to the plan to support and intervene for children prescribed in Point b, Clause 1, Article 10 of Circular No. 14/2020/TT-LDTBXH implemented by the People's Committee at the commune level.
The Ministry of Health clearly stated its responsibility to carry out the tasks specified in Clause 2, Article 15 of Circular No. 14/2020/TT-LDTBXH implemented by the People's Committees at the commune level.
This Circular takes effect from July 1, 2025; expires from March 1, 2027.
The Ministry of Health emphasizes: During the effective period of this Circular, if the regulations on the authority and responsibility of state management in this Circular are different from the Circulars issued by the Minister of Health before the 1st. 7.2025 shall comply with the provisions of this Circular.
