Sending a question to the Ministry of Health, Ms. Nguyen Thi Loan (character name changed - PV) requested to be answered in the following case:
Subjects who have submitted applications for monthly social allowances (subjects considered for disability by the Commune People's Committee) before the effective date of Decree No. 147/2025/ND-CP, but the old District People's Committee has not yet made a decision on receiving monthly social allowances.
The new Chairman of the Commune-level People's Committee, based on the dossiers and documents of the subject, shall carry out the order and procedures for issuing monthly social allowance decisions for the subject according to regulations. Article 4 stipulates that the benefit period is from the month the Chairman of the Commune-level People's Committee signs the decision.
Ms. Loan asked, so is the application file that the Commune People's Committee sent to the district from April 2025 retroactively received?
Regarding this issue, the Ministry of Health answers as follows:
Decree No. 147/2025/ND-CP dated June 12, 2025 of the Government stipulating the demarcation of authority of local authorities at 2 levels in the field of state management of the Ministry of Health takes effect from July 1, 2025.
Point d, Clause 2, Article 5 of Decree No. 147/2025/ND-CP stipulates:
In case the subject has submitted a dossier requesting social allowance and financial support for monthly care and nurturing before the effective date of this Decree but there is no decision on social allowance and financial support for monthly care and nurturing, the Chairman of the Commune People's Committee shall, based on the subject's dossier and documents, carry out the order and procedures for deciding on social allowance and financial support for monthly care and nurturing for the subject according to the provisions of point b of this clause. The subject is not required to redo the documents specified in point a of this clause".
Point b, Clause 2, Article 5 of Decree No. 147/2025/ND-CP stipulates:
Within 10 working days from the date of receiving the subject's request, the Chairman of the Commune-level People's Committee shall organize the review, verification and standardization of relevant information of the subject with the national population database, decide and implement monthly social allowance payments, and support monthly care and nurturing expenses for the subject. The benefit period is from the month the Chairman of the Commune-level People's Committee signs the decision".
Thus, from July 1, 2025, the time to enjoy social allowances is from the month the Chairman of the Commune People's Committee signs the decision.
