On the afternoon of October 2, at a regular press conference, Lieutenant Colonel Nguyen Van Binh - Deputy Head of the Traffic Police Department (CSGT- PC08), Ho Chi Minh City Police - said that the Traffic Police Department will advise the City Police Department to coordinate with the Department of Justice, the Department of Construction and relevant agencies to study and propose adding public labor sanctions to the Law on Handling of Administrative Violations and the Law on Road Traffic Safety and Order.
Previously, the Chairman of the Ho Chi Minh City People's Committee assigned the Ho Chi Minh City Police to preside over and coordinate with departments and branches to study and recommend competent authorities to consider amending and supplementing the Law on Handling of Administrative Violations to suit the new situation. In particular, it is necessary to study and propose adding new forms of punishment, such as public service.
According to Lieutenant Colonel Nguyen Van Binh, this measure aims to increase deterrence and raise people's awareness. Currently, the main penalty is still a fine, but in reality, it is not enough deterrent. Many cases of violations have recurred.
"If the form of public service labor is added, violators will be directly responsible to the community through activities such as environmental sanitation, garbage collection, painted lines, cleaning at public places... This will be a practical lesson, helping people raise their awareness of law compliance when participating in traffic" - Lieutenant Colonel Nguyen Van Binh emphasized.
Lieutenant Colonel Nguyen Van Binh added that according to the provisions of the current Law on Handling of Administrative Violations, the forms of punishment include: warning; fine; revocation of the right to use a license, practice certificate or temporary suspension of activities; confiscation of exhibits, means; deportation (for foreign organizations and individuals).
In addition, there are also remedial measures such as forcing restoration to the original state, dismantling illegal constructions, destroying damaged exhibits or returning illegal profits.
In the field of road traffic, the main sanctions are still warnings, fines, revocation of driving licenses for a period of time, temporary detention or confiscation of vehicles and forced remediation of consequences.
Vietnam has not yet applied public labor sanctions in traffic fines. However, many countries such as Singapore, Korea, and Japan have implemented and recorded positive results. This form is not only educational but also contributes to creating deterrence, limiting the situation of recidivism.
Lieutenant Colonel Nguyen Van Binh said that in the coming time, functional units will develop specific implementation mechanisms, clearly defining which violations will be applied, public service working hours, monitoring units as well as the rights and obligations of violators.
In the immediate future, this form can be piloted in some key areas before expanding. The implementation will ensure humanity, safety, health ease, not being forced or harming the legitimate rights of violators.
