The Ministry of Construction drafted a Circular stipulating a list of areas and terms for people with positions and powers who are not allowed to establish, hold positions and positions in the management and operation of private enterprises, limited liability companies, joint stock companies, joint stock companies, and cooperatives after leaving their positions under the management of the Ministry of Construction.
Clause 1, Article 5 stipulates that within a period of 24 months from the date of resignation from office as prescribed by the competent authority, people with positions and powers working in the fields specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and Clause 11, Article 4 of this Circular shall not be established or hold the title or position of managing or operating a private enterprise, limited liability company, joint stock company, or cooperative in the field under their previous management responsibility.
According to regulations, the following positions within 24 months of ceasing to hold positions cannot be established or run private enterprises, including:
Construction planning, architecture. Planning, planning and development policies for road, rail, inland waterway, maritime, and civil aviation transport according to the provisions of law.
Construction investment activities. Management of investment, construction, maintenance, and protection of road, rail, inland waterway, maritime and civil aviation transport infrastructure according to the provisions of law.
Urban development.
Technical infrastructure.
Housing, offices and real estate market.
Construction materials.
State management of means of transport, general walls, systems, and spare parts of means of transport; means, equipment for exploration, exploitation, and transportation at sea; specialized means and equipment for dismantling and construction; machinery, equipment, and materials with strict requirements for safety and hygiene in transportation and specialized technical equipment and equipment according to the provisions of law.
Management of training, coaching, testing, granting, recognizing, revoking licenses, certificates, and professional certificates for drivers of means of transport, operators of means of transport, and specialized equipment in transportation (except for the task of testing and granting road motor vehicle driving licenses; drivers of vehicles and specialized equipment serving national defense, security, and fishing vessels); inspectors, inspection staff, and specific subjects working in the field of transportation according to the provisions of law.
Management of road, rail, inland waterway, maritime, civil aviation and multi-modal transportation activities.
State management of traffic security and safety according to the provisions of law.
State management of public services in sectors and fields under the state management of the ministry according to the provisions of law.
