Bac Ninh Provincial Inspectorate has just issued Notice No. 268/TB-TTT. NV9 Notice of Inspection Conclusion on the compliance with policies and laws on auction, investment, land, environment, construction, real estate business in the process of implementation for the project: Investment and construction of Housing Area in Chau Khe ward, Tu Son town (now Phu Khe ward, Bac Ninh province).
This is a project invested by Chau Khe Ward People's Committee (now Phu Khe Ward, Bac Ninh province); Cat Loi Urban Development Investment Joint Stock Company (Cat Loi Company) is the unit that won the auction for land use rights and construction investment.
Accordingly, the state allocates land with land use fees in the form of land use right auctions to invest in building residential areas. The total area of the land area is 66,484.3m2, of which the residential land area auctioned for land use rights is 23,194.3m2 (173 lots). Land use right winning bid price: 98,812,000 VND.
Notably, regarding the implementation of construction investment, the Inspectorate of Bac Ninh province pointed out:
The item of undergrounding the 35kV power line from pole 4 to pole 8 of the 35kV branch N.THCK1 road 372 E27. 3 passing through the project land area is not included in the construction content approved by the Chairman of Bac Ninh Provincial People's Committee. The construction, consulting and acceptance testing value of the undergrounding part of the 35kV power line is 3,167,578,834 VND.
The investor did not perform some tasks (Cost of preparing bidding documents, evaluating bid documents, cost of appraising contractor selection for project management consulting packages, design consulting, construction) with a total value of 1,2039,550,000 VND.
Construction contracts do not have contract negotiation minutes.
The investor did not perform the work of selecting construction insurance contractors, did not purchase construction insurance when implementing the project according to the provisions of Article 9 of the 2014 Construction Law. Construction insurance costs approved in the estimate are: 50,306,000 VND.
Regarding construction progress management: By the time of inspection, the project had expired its implementation period (2020-2021), the investor had not completed construction, had not submitted to competent authorities for inspection of the acceptance of completion of construction items and construction works, and had not handed over the works.
The investor, Phu Khe Ward People's Committee (formerly Chau Khe) has not seriously implemented the management of construction order and land management: 26 construction works violated construction order and some construction works were not in accordance with the detailed plan of the project.
Notably, Cat Loi Company prepared a dossier, requesting the Department of Natural Resources and Environment to notify about the eligibility for transferring land use rights when the entire technical infrastructure has not been completed.
