Many violating works are handled
Recently, in Hanoi, the management of construction order has had many positive changes, especially since the implementation of the 2-level local government model. Thanks to that, the situation of illegal construction and illegal construction on public land and agricultural land has been gradually controlled and significantly improved.
However, in addition to the achieved results, the management of construction order in some wards and communes still has limitations, causing problems in public opinion.
The Steering Committee for Enforcement of Kieu Phu Commune, Hanoi City has just organized the implementation of enforcement, forcing the demolition of all construction works violating the encroachment on public land managed by the State of Mr. Nguyen Van Phuc's household (residing in Hamlet 7, The Tru Village, Kieu Phu Commune).

According to the inspection records, the project of Mr. Nguyen Van Phuc's household was built without permission on public land managed by the People's Committee of Kieu Phu commune. Although the authorities have repeatedly drawn up violation records, issued decisions to suspend and requested voluntary dismantling, the household still does not comply.
Based on the provisions of law and the enforcement plan approved by the Commune People's Committee, the Kieu Phu Commune Enforcement Steering Committee has organized the implementation of professional steps in accordance with the procedures prescribed by the Land Law and regulations on construction order.
The violating project has a total area of 115.7m2, located on plot No. 280, map sheet No. 17 under the management of Kieu Phu Commune People's Committee. The project consists of two items: Category 1 is a level 4 house with an area of 39.33m2, built with a red brick wall, measuring 5.7m x 6.9m, 3.4m high. Category 2 is a level 4 house with an area of 76.37m2, steel frame structure, steel truss, corrugated iron roof.
The Chairman of Phung Huy Dien Commune People's Committee emphasized that resolutely handling violations is a necessary requirement to restore discipline in land management, prevent land encroachment and misuse.
At the same time, it is required that the forces participating in enforcement perform their functions and procedures correctly, ensuring absolute safety for people and property.
In Dinh Cong ward, on December 13, the authorities organized a convoy of vehicles to move through many routes, alleys, and residential areas to propagate, remind, and handle violations, contributing to building the ward to ensure urban order.
On the same day, Dinh Cong ward organized the clearance and dismantling of re-encroachment works on public land and agricultural land that had been handed over to serve the site clearance of the Ring Road 2.5 Construction Investment Project (Dam Hong to National Highway 1A section).
The organization of clearance and demolition of construction works that violate re-encroachment continues to affirm the strictness of the law, while demonstrating the effectiveness and efficiency in administrative management, land management and construction order management in the area.
Strictly handle violations from the time they arise
Associate Professor, Dr. Bui Thi An - Deputy Head of the Economic Advisory Council (Vietnam Fatherland Front Committee of Hanoi) said that, with the specific and sensitive nature of agricultural land use, competent authorities need to carefully consider management solutions, in order to both promote development and avoid abuse, causing loss of the capital's valuable agricultural land fund.
To improve the management of urban construction order and order, Ms. An said that the authorities need to strengthen patrolling and inspection work, promptly detect and strictly handle violations right from the time they arise. The handling must ensure timeliness in preparing documents, and must be finalized in the implementation stage.
According to Associate Professor, Dr. Bui Thi An, the process of preparing violation records needs to be carried out quickly and transparently; in particular, there must be measures to thoroughly enforce the demolition of the violating construction, in accordance with the requirements of restoring the original state. Without strong and decisive enforcement measures, the commitments of the investor or project owner will only stop on paper.
"It is time for authorities at all levels to turn "resolutely handle" commitments into specific actions, completely dismantling illegal constructions.
Only when the law is strictly enforced, fairly and decisively can negative consequences such as prolonged complaints and disorder of national security and order be prevented, thereby contributing to building a civilized and orderly capital," emphasized Associate Professor, Dr. Bui Thi An.
