Golden land hanging, people suffer
Dien Nam - Dien Ngoc area was once considered the "fire land" of the old Quang Nam (now Dien Ban Dong ward, Da Nang city). More than 20 years ago, thousands of hectares of fertile agricultural land were reclaimed for urban projects. However, instead of a modern urban area as planned, the reality is now a shabby picture: Unfinished projects, degraded infrastructure, abandoned land.
"The abandoned land is gone. The land has not been compensated but they dare to deposit and zoning to sell, said Ms. Phan Thi Hoa (Dien Ban Dong ward, Da Nang) indignantly. The current status of the new urban area of Dien Nam - Dien Ngoc is difficult to distinguish between urban areas or... deserted fields.
"When you say urban, you don't see urban. Abandoned and wasteful while farmers have no land for production, said Mr. Dang Ngon (Dien Ban Dong ward).
According to statistics, the new urban area of Dien Nam - Dien Ngoc has about 100 projects, but up to now, there are more than 70 projects with unfinished infrastructure and not meeting legal requirements. The total area of the area is up to about 2,700 hectares, most of which are abandoned, causing serious waste of land resources.
The project creates a hot spot for complaints
Not only farmers lose land, thousands of people who buy project land also fall into the situation of "losing money, not seeing red books". Many projects have not been approved for detailed planning 1/500, have not been allocated land, have not paid land use fees, but the investor has gone through brokerage to divide plots, sell plots, earning thousands of billions of VND. Typically, projects invested by Bach Dat An Joint Stock Company, through the distributor, Hoang Nhat Nam Company. Although not meeting legal requirements, these enterprises have "drawn" projects, sold more than 1,000 plots of land, earning more than 557 billion VND. As a result, thousands of land buyers have had to give up their jobs and gather to file lawsuits for many years, causing disorder. "We know that large gatherings cause consequences, but there is no other way to claim our legitimate rights," said Mr. Nguyen Dinh Nam - a project land buyer.
The dispute between the investor and the distributor was brought to court, the verdict was effective, and the buyer's rights were determined. However, many years have passed, and the verdict has not been carried out, causing people to continue to fall into a deadlock.
The new urban area of Dien Nam - Dien Ngoc has become a hot spot for land complaints for many years. Some local officials have been involved in labor relations related to clearance and compensation. "It's beautiful to plan on paper, but in reality, the land is being wasted too much," Ms. Le Thi Khieu (Dien Ban Dong ward) shared.
According to local authorities, the main reason is the widespread handover of projects to investors with weak capacity and lack of inspection and supervision. Many BT projects exchange land for infrastructure, but businesses have been selling land for a long time, while the infrastructure is still unfinished and unable to be connected. "Overall, the new urban area does not meet the requirements," admitted a leader of Dien Ban Dong ward.
According to the 2013 Land Law, land allocated to implement an investment project without use for 12 consecutive months or behind schedule for 24 months has the right to be recovered by the State. However, more than 20 years have passed, the new urban area of Dien Nam - Dien Ngoc still has an old, shabby appearance. The Government Inspectorate is inspecting more than 70 projects here. Da Nang also requested the police to investigate and strictly handle violations of related enterprises. However, people are still waiting for a definitive solution. According to Lawyer Nguyen Anh Tuan - Da Nang Bar Association, businesses taking advantage of legal loopholes, "hiding lights in front of cars", selling land without meeting legal requirements is a deep cause leading to current consequences.

Can't let the waste last any longer
Recently, Vice Chairman of the People's Committee of Da Nang City Tran Nam Hung led a working group to inspect 3 real estate projects, including the 7B Urban Area Expansion, Hera Complex Riverside Urban Area and Bach Dat Urban Area, invested by Bach Dat An Joint Stock Company in Dien Ban Dong Ward. These are 3 projects in which Bach Dat An Joint Stock Company (investor) signed a contract to assign Hoang Nhat Nam Company to distribute about 1,000 plots of land. After that, the parties arose a dispute, went to court and thousands of customers had to wait.
Vice Chairman of the People's Committee of Da Nang City Tran Nam Hung emphasized that the ultimate goal is to remove obstacles of the 3 projects to issue land use right certificates to people. In particular, it is noted that businesses need to ensure financial capacity to continue investing in infrastructure, compensating people and paying land use fees. After completing the obligations, the city leaders will immediately direct the issuance of land use right certificates. The goal of the three projects is to complete site clearance in December 2025.
