In August 2025, the Phap Che Committee of the Khanh Hoa Provincial People's Council gave its opinion on handling problems related to commune-level People's Council delegates.
After the merger, the number of commune-level administrative units of the new Khanh Hoa province has decreased significantly, specifically to only 65 units, including 48 communes, 16 wards and 1 special zone.
During the operation of the People's Council at the commune level, a number of difficulties and problems arose.
Specifically, for personnel who are not People's Council delegates but are appointed to hold the positions of Chairman, Vice Chairman, Head of Committees of People's Councils at the commune level.
Regarding this, the Legal Committee believes that people who are not People's Council delegates appointed by the Standing Committee of the Provincial People's Council to hold the positions of Chairman, Vice Chairman, and Head of Committees of the People's Council at the commune level are included in the total number of People's Council delegates of that administrative unit.
This personnel is responsible for performing all duties and powers of the People's Council delegates according to the provisions of law.
Regarding the transfer of activities of People's Council delegates at the commune level from one locality to another, the Legal Committee said that the Standing Committee of the Provincial People's Council has no legal basis for implementation.
The Legal Committee of Khanh Hoa Provincial People's Council requests the Standing Committee of Khanh Hoa Provincial People's Council and delegates of the People's Council at the commune level to perform their duties and powers according to the provisions of the Law on Organization of Local Government No. 72/2025/QH15 and related legal documents.
There are also questions about the regime and policies for personnel who are not People's Council delegates but are appointed to hold positions in the Ward People's Council.
Regarding this, the Economic - Budget Committee has submitted a document in July 2025 on the registration of the development of a resolution regulating a number of payment regimes for the activities of People's Councils at all levels.
During the process of developing a resolution, the Economic - Budget Committee will submit to the Khanh Hoa Provincial People's Council for consideration in the direction of ensuring the regime as the People's Council delegates at all levels for these cases.
