Difficult districts make recommendations for inadequacies
In Dam Rong district, most of the cadres, civil servants, etc. are working in areas with particularly difficult socio-economic conditions. Many of them have worked for 15 years or more.
Recently, the implementation of the Central Government's policy on arranging and organizing the political system has received high consensus from the district's officials.
However, in reality, when implementing Decrees No. 178/2024/ND-CP (Decree 178) and 67/2025/ND-CP (Decree 67) the People's Committee of Dam Rong district found some shortcomings and dissatisfactions.
According to Decree No. 135/2020/ND-CP (Decree 135), people working in areas with particularly difficult socio-economic conditions for 15 years or more can retire early according to the policy of streamlining and streamlining the apparatus (with an age lower than the retirement age prescribed by the Law on Social Insurance).
However, early retirement of no more than 5 years compared to the retirement age under normal working conditions (applied according to Appendix II of Decree 135) has many shortcomings in implementing Decree 178 and Decree No. 67.
According to Article 7, Decree 178 (amended in Decree 67), people who have worked for 15 years in areas with particularly difficult socio-economic conditions will retire when they are 57 years old according to the policy of restructuring the apparatus, instead of 62 years old like other areas.
For example, both people are of the same age, with the same working time and equivalent position, and all apply for early retirement.
However, people who do not work in areas with particularly difficult socio-economic conditions will enjoy a longer retirement period than those working in areas with particularly difficult socio-economic conditions.
Another problem also arises when comparing cadres working in areas with particularly difficult socio-economic conditions but with different working hours.
A person who starts working one year or more later and has not worked for 15 years in an area with particularly difficult socio-economic conditions will, when implementing the policy of restructuring the apparatus, be subject to early retirement according to the provisions of Appendix I, Decree 135.
Meanwhile, for those who have worked for 15 years or more, when calculating the retirement age, it is applied according to Appendix II, Decree 135, leading to these people not being entitled to the same regime.
In the case of both people working in areas with particularly difficult socio-economic conditions. However, a person who has worked for less than 15 years is mobilized by competent authorities to work in another region.
While the remaining people continue to work for 15 years or more in areas with particularly difficult socio-economic conditions, when calculating the early retirement regime to reorganize the apparatus, those who have worked for less than 15 years will apply Appendix I, Decree 135 to calculate.
While those who have worked for 15 years apply Appendix II, Decree No. 135 to calculate policies.
This is also not commensurate in the application of early retirement policies. Because people who work longer in extremely disadvantaged areas do not enjoy the same benefits as those who work for a shorter period of time.
There is another problem related to cadres who have worked for 15 years in areas with particularly difficult socio-economic conditions but are 57 years old when they wish to retire early to streamline and reorganize the apparatus.
In this case, retirees will not enjoy the policies according to the provisions of Decree 178 like officials working in other regions.
Meanwhile, they have had enough time to work and fulfill their obligations.
Proposing the Ministry of Home Affairs to pay attention and consider
Mr. Lieng Hot Ha Hai - Vice Chairman of Dam Rong District People's Committee - shared: "I was born in 1968, have worked in the locality for 30 years and will have worked for another 5 years before retirement age".
According to Mr. Lieng Hot Ha Hai, if he responded to the policy of streamlining the apparatus and voluntarily retiring early, he and many colleagues would not be entitled to the same benefits as those working in other areas.
Therefore, Mr. Lieng Hot Ha Hai expressed his hope that the competent authority would consider and adjust the policy to ensure the rights of long-time staff working in areas with particularly difficult socio-economic conditions.
Regarding this issue, Ms. Pham Thi Tuong Van, Director of Lam Dong Provincial Department of Home Affairs, said: "The unit has received an official dispatch from Dam Rong District People's Committee on recommendations on policies and regimes according to Decree 178 and Decree 67".
Based on the recommendations of localities, the department has compiled and recommended the Ministry of Home Affairs to pay attention to and consider the difficulties in implementing Decree 178.
