There is nearly 1 month left until the New Year holiday in 2026. According to the Labor Code, employees are entitled to 1 day's work break and receive full pay.

Accordingly, the New Year's Day in 2026 falls on Thursday, January 1, 2026. Thus, cadres, civil servants and employees will have 1 day off. If they want to extend their holiday, workers (civil servants and public employees working in the public sector) can apply for leave on Friday, January 2, 2026. If they take a day off, workers can take two more days off on the weekend, which are Saturday and Sunday.

For some businesses with a working schedule of half a day on Saturday or until the end of Saturday, employees must apply for a 2-day leave on Friday and Saturday if they want to extend the Tet holiday to 4 days.

The 2019 Labor Code stipulates that employees who are on holiday or annual leave are entitled to full pay. Thus, workers can use the day off to extend the leave. Thereby reclaiming labor, having time to visit family or go out.

Sharing about the New Year holiday plan, Ms. Nguyen Thuy Van (Thanh Hoa - currently working in Hanoi) said she plans to return to her hometown to visit a family member who is sick during the New Year.

According to the regulations, there is only 1 day off, so Ms. Van has asked for an additional 6 days off after the New Year's Day, combined with a 7th and 7th weekends and Sundays, so her family will have 4 days off in the countryside to welcome the new year 2026 with her family.

"Last year, I took a lot of leave, so I still had many days off. I reserve this leave for special occasions, so that I can return to my hometown with my family for longer. Because we don't have children to go to school, my husband and I can easily proactively arrange a holiday schedule for work "- Ms. Van shared.

In addition to holiday salary, workers are also paid overtime

In addition to regulating the holiday and Tet holiday during the year, the 2019 Labor Code also stipulates the holiday, working time, as well as salary if employees work on a holiday...

According to Decree 12/2022/ND-CP, if violating regulations on working hours and rest time, employers who do not ensure employees' unpaid leave, unpaid leave according to the provisions of law or do not notify in writing the Department of Labor - Invalids and Social Affairs (now the Department of Home Affairs) where they organize overtime and the head office for organizing overtime from over 200 hours to 300 hours in a year will be fined.

In addition, an employer will be fined 10-20 million VND for violating the provisions of the law on weekly holidays or annual holidays or holidays, Tet, etc.

Accordingly, if the employer is an organization, the fine is twice that of an individual. Thus, if the employer violates the regulations on Tet holidays, the fine is 10-20 million VND for individuals. As for the organization, the fine will be 20-40 million VND.

On the other hand, employers can organize work if there is the consent of employees on this occasion. In addition to holiday wages, workers are also paid overtime.

Therefore, in case there are employees who want to work on days off, they will be paid for extra work. Accordingly, employees will be paid overtime on holidays, Tet or on holidays with a salary of at least 300% compared to normal daily salary.

Overtime wages are determined according to Article 98 of the Labor Code as follows: Overtime wages = 300% x Unified salary or actual salary paid for work.

Overtime salary at night = 390% x Unified salary or actual salary paid for work in progress.
