Reusing surplus houses and land

More than 2 months since the official merger of An Xuan and Phuoc Hoa wards (Tam Ky city, Quang Nam province), the new An Xuan ward has quickly stabilized the apparatus, focusing on handling administrative procedures for people.

Mr. Bui Tan Cong - Head of the Department of Internal Affairs of Tam Ky City (former Chairman of the People's Committee of An Xuan Ward) said that after the merger, the apparatus was reduced from 38 people to 29 people. The conversion and editing of records and documents for people related to the arrangement of administrative units is completely free of charge. The people's satisfaction rate is nearly 100%.

All Party and government agencies are deployed at the headquarters of the An Xuan Ward People's Committee, while the Front, Mass Mobilization, and Union blocks work at the headquarters of the old Phuoc Hoa Ward People's Committee. Thanks to that, there is no longer a situation where many associations and unions have to work in a small room like before and solve the problem of surplus headquarters after the merger.

Chairman of the People's Committee of Quang Nam province Le Van Dung said that, implementing the direction of General Secretary To Lam: "We must resolutely fight waste in the management and use of public assets, especially land, offices...", Quang Nam identified fighting waste in post-arrangement facilities as an extremely urgent and necessary matter in the context of strong reforms in the whole country.

"Wherever it is possible to arrange for any agency, priority should be given to the arrangement, for example, if the commune police in the near future are added more people, they will arrange a spacious workplace, taking advantage of the redundant district-level headquarters for convenient work.

Where there is really no solution to handle it, the headquarters must be liquidated soon, to promote land resources there" - Chairman of the People's Committee of Quang Nam province said.

Temporarily suspending construction and repair of new headquarters

On March 3, Quang Nam leaders confirmed that they have decided to temporarily suspend the construction and repair of new offices in 2025, for provincial agencies and units that are waiting for the reorganization of the apparatus; wait until the reorganization is completed to propose a repair and maintenance plan for offices to ensure demand and be suitable for the actual situation.

Previously, the province also issued a decision to handle 247/388 houses and land that were not used, used inefficiently, and used for the wrong purpose.

"When merging, many departments at the provincial and district levels will certainly have to work in 2 places in the first years, but cannot work in one place.

Because working in one place is not enough, but building a new one is still a waste. Therefore, many units continue to use the current headquarters until the depreciation period ends. That is also a solution to fight waste" - Chairman of Quang Nam province said.

Lawyer Nguyen Thanh Tan, Quang Nam Bar Association, said that currently, the management and use of land and surplus headquarters after the arrangement is regulated in detail in Decree No. 03/2025/ND-CP of the Government, effective from January 1, 2025, replacing previous Decrees.

According to Decree 03/2025/ND-CP, there are 5 forms of rearrangement and handling of public houses and land, including: Continuing to use, when the agency, organization, or unit has a need to use the house and land in accordance with standards, norms and legal regulations;

Recovering: when the house or land is no longer needed or is not used for the right purpose, violating legal regulations;

Transfer: applied when it is necessary to transfer houses and land from one agency, organization, or unit to another for more effective use;

Transfer to local management and handling: When the house or land is no longer suitable for the needs of central agencies, organizations and units, it can be transferred to local management and use.

Temporarily suspend continued use: Apply when necessary, when the above forms cannot be immediately implemented.

In addition, Decree 03/2025/ND-CP also emphasizes the responsibility of agencies, organizations and units in managing and using public assets, ensuring efficiency, avoiding waste and loss of state assets.

The issuance of Decree 03/2025/ND-CP aims to overcome shortcomings in previous regulations, creating a clear and transparent legal framework for the management and use of public assets after the process of arranging and merging agencies and units - Lawyer Tan assessed.

According to the People's Committee of Quang Nam province, in 2024, the province has tightened the management of capital investment and construction, saving the state budget more than 459 billion VND; saving 10% of regular expenditures to create a source for salary reform for budget units under the provincial budget and district-level People's Committees of more than 375 billion VND...

The province aims to complete the plan to arrange and handle surplus headquarters for agencies and units subject to administrative unit arrangement in the period of 2023 - 2025 according to Resolution No. 1241/NQ-UBTVQH15.
