Slow progress, inflating charter capital
The project to invest in the construction of the AAC air-cured concrete brick factory (Project) of Vietnam Air-cured Concrete Joint Stock Company (the company) - was granted an investment certificate by the Phu Tho Provincial People's Committee in 2010 in Dong Dau area, Co Tiet commune, Tam Nong district (now Van Xuan commune).
Recorded by Lao Dong Newspaper reporters in early March, the Project is located on a large land area located between provincial road 315 and Thao right dike (Red River dike).
Recently, the Phu Tho Provincial Inspectorate issued an inspection conclusion, pointing out a series of violations of the Project.
Accordingly, although the Phu Tho Provincial People's Committee has created conditions for adjustment and extension many times, the Project is still more than 5 years behind schedule compared to the most recent extension time in Decision No. 3407/QD-UBND dated December 7, 2018.
Notably, the company has increased its charter capital to 500 billion VND at the beginning of 2024.However, in reality, shareholders have only contributed more than 17 billion VND, the amount of capital not yet contributed is nearly 483 billion VND, violating the provisions of the 2020 Enterprise Law.
Series of violations in the fields of construction, land, and environment
Also according to the Phu Tho Provincial Inspectorate, the AAC air-cured concrete brick factory project still has violations in the fields of construction, land and environment.
In the process of project implementation, the company committed administrative violations regarding the organization of construction without a construction permit.
At the end of March 2019, the old Tam Nong District People's Committee sanctioned administrative violations in the field of construction against the company.Although the fine has been paid, the remedial measures according to the sanctioning decision have not been implemented.
At the Project, many items have not been built with sufficient area or have not been deployed such as finished product warehouses, sports playgrounds, lakes, green trees, lightning protection systems...
In particular, instead of building a brick factory as licensed, in January 2025, the company arbitrarily installed a quartz powder production technology line with a designed capacity of 60,000 tons of products/year.
Not only that, the company also arbitrarily drilled and used drilled wells (flow of 1-5m3/day and night) without registering for exploitation and use of water resources according to regulations.
Regarding financial obligations, the company pays amounts to the State budget that do not ensure the deadline for payment as prescribed, such as: Land rent, non-agricultural land use tax.
Many recommendations of Phu Tho Provincial Inspectorate
Faced with the above-mentioned series of violations, the Phu Tho Provincial Inspectorate requested the company not to produce quartz powder without the approval of the State agency.
At the same time, strictly comply with the provisions of law on investment, construction, land, environmental protection, water resources and related laws.
Phu Tho Provincial Inspectorate also proposed that the Provincial People's Committee direct the Department of Finance to organize a review of the responsibilities of collectives and individuals in detecting violations of the company that have not been handled according to the provisions of law.
Van Xuan Commune People's Committee is responsible for inspecting, supervising, and urging the company to fully comply with the provisions of law on investment, land, construction, water resources, environmental protection...Promptly detect, handle or propose handling violations according to the provisions of law.
At the same time, organize a review of the responsibilities of collectives and individuals in urging the implementation of the decision to sanction administrative violations of the Chairman of Tam Nong District People's Committee (old) and allowing the company to install a quartz powder production line without the approval of the Provincial People's Committee.
