According to the provisions of Decree 158/2025/ND-CP, employers are responsible for fully paying compulsory social insurance for employees who are eligible to participate.
In case the employee quits or terminates the labor contract, the enterprise must fulfill the obligation to pay social insurance to ensure the settlement of related regimes. If the enterprise has not paid enough, the rights of the employee are still resolved based on the time it has paid social insurance. After recovering the full amount to be paid, the social insurance agency will confirm the additional payment time and adjust the level of benefits for the employee.
In particular, for businesses that are no longer able to pay social insurance for employees before July 1, 2024, the current policy allows confirmation of the contribution period as a basis for settling pension and death benefits, contributing to minimizing disadvantages for employees.
