A pension regulation takes effect from May 2026

A regulation on pensions of Vietnam Social Security (BHXH) takes effect from May 2026.

The Director of Vietnam Social Security signed and issued Decision No. 366/QD-BHXH on the Process of collecting social insurance, health insurance, unemployment insurance; issuing social insurance books and health insurance cards. The decision takes effect from May 1, 2026.

One of the notable highlights of this Decision related to pensions is according to point c, clause 1, Article 4.

Accordingly, Social Insurance guides the declaration, submission of registration dossiers, payment of money; adjusts information on social insurance, health insurance, unemployment insurance participation and issuing social insurance books and health insurance cards for participants as follows:

Cases of adjusting social insurance and health insurance information; re-issuance of social insurance books and health insurance cards; confirmation of social insurance contribution time in cases where employers are no longer able to pay social insurance before July 1, 2024 to serve as a basis for resolving and adjusting pension and death benefits; calculation of working time for participants before January 1, 1995; calculation of working time for commune officials who held positions under Decree No. 09/1998/ND-CP before January 1, 1998; adjustment of titles for heavy, hazardous, dangerous or especially heavy, hazardous, dangerous occupations or jobs before 1995; compulsory social insurance contribution for the remaining period of no more than 06 months to be eligible for monthly pension or death benefits; consolidation of social insurance books; return of social insurance and unemployment insurance,...: declare dossiers together with copies of relevant documents (if any) and submit them to the employer or social insurance agency.

Vietnam Social Security said that the process is issued according to Decision No. 366/QD-BHXH to adjust the decentralization and delegation of power to organizations and individuals under the Vietnam Social Security system in implementing the collection and issuance of social insurance books and health insurance cards according to the principle of "clear people, clear tasks, clear responsibilities, clear time, clear results".

The process clearly stipulates the responsibilities of grassroots social insurance, provincial social insurance and Vietnam Social Security in implementing the collection and issuance of social insurance books and health insurance cards.

In which, grassroots social insurance implements guidance for employers, management agencies of people who only participate in health insurance, organizes support for the development of subjects and participants to declare and submit dossiers; collect and refund social insurance, health insurance, and unemployment insurance contributions; issue social insurance books and health insurance cards; confirm social insurance books; merge social insurance books; adjust information of participants; reissue and exchange health insurance cards; return administrative procedure results. At the same time, receive dossiers to transfer to provincial social insurance to resolve cases of calculating working time before January 1, 1995 or commune officials according to Decree No. 09/1998/ND-CP before January 1, 1998.

Provincial Social Insurance is responsible for guiding and resolving dossiers under its authority; receiving and supporting the handling of dossiers and data with problems requested by grassroots Social Insurance; reporting and proposing to Vietnam Social Insurance to resolve if it exceeds its authority.

For Vietnam Social Security, the process stipulates the implementation of collecting central budget contributions, supporting social insurance, health insurance, unemployment insurance, and labor accident insurance contributions, and resolving dossiers in cases where grassroots social insurance does not promptly resolve them.

Vietnam Social Security also said that the new process continues to promote the application of information technology and digital transformation in resolving administrative procedures.

Accordingly, participants are allowed to use electronic social insurance books to settle social insurance and unemployment insurance benefits; use electronic health insurance cards for health insurance medical examination and treatment and pay for health insurance medical examination and treatment costs through the National Electronic Identification Application (VNeID) level 2, VssID application or Email.

For electronic transaction records, the software system verifies all information of the unit and participants according to the electronic identification code, ensuring that it matches the national database on insurance, the national database on population and the database on residence.

In case the dossier is complete, accurate, and automatic software creates and generates it, the system will automatically update it to the database; automatically issue electronic versions of social insurance books and health insurance cards, and confirm the social insurance and unemployment insurance payment process for cases of electronic registration.
