This policy will also apply to the remaining business owners of business households with business registration, but from July 1, 2029.
That is the regulation in Decree No. 158/2025/ND-CP dated June 25, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance.
This policy creates opportunities for business owners to access and enjoy sustainable social security regimes such as: Retirement, sickness, maternity, ... similar to those of employees working under labor contracts.
The lowest payment level is 585,000 VND/month (in July 2025)
According to the Social Insurance Law 2014 (now expired), individual business owners (IPs) are not subject to compulsory social insurance but are subject to voluntary social insurance if needed.
However, from July 1, 2025, when the Social Insurance Law 2024 takes effect, replacing the Social Insurance Law 2014, owners of residential land with business registration according to Government regulations (except for cases where they have reached the retirement age prescribed in Clause 2, Article 169 of the Labor Code) are required to participate in social insurance.
The payment basis, payment level and method of compulsory social insurance payment of the owner of a residential area are as follows:
- Regarding the contribution level and contribution basis:
According to regulations, the monthly contribution rate is calculated according to the percentage of salary used as the basis for compulsory social insurance contributions, equal to 3% to the sickness and maternity fund, 10% to the retirement and death fund.
Business owners are allowed to choose salary as the basis for compulsory social insurance contributions, but the lowest is the reference level and the highest is 20 times the reference level at the time of contribution; the current reference level is the basic salary (2,340,000 VND/month). Therefore, the current contribution rate of the household owner is specifically:
- The lowest compulsory social insurance contribution rate is VND 585,000/month (25% x VND 2,340,000/month).
- The highest compulsory social insurance contribution rate today is 11,700,000 VND/month (25% x 20 times x 2,340,000 VND/month).
The compulsory social insurance contribution rate of residential land owners will change depending on the reference level (at the time of July 2025, the reference level is equal to the basic salary).
- Regarding payment methods: Households can choose to flexibly pay monthly, 3 months or 6 months at a time depending on their needs.
Ensuring the rights of owners of residential land owners who have previously participated in compulsory social insurance
Social insurance benefits for owners of residential land with compulsory social insurance payment procedures have been resolved in accordance with regulations.
According to Resolution No. 78/2025/UBTVQH15 dated May 19, 2025 of the National Assembly Standing Committee on recording the compulsory social insurance payment period of business owners who participated before the effective date of Social Insurance Law No. 41/2024/QH15 (before July 1, 2025), it is stipulated as follows:
- Record the time the business owner has paid compulsory social insurance before July 1, 2025 as a basis for resolving the social insurance regime according to the provisions of the law on social insurance.
- Business owners who are eligible for social insurance benefits before the effective date of this Resolution will be eligible for social insurance benefits from the date of eligibility for social insurance benefits according to regulations.
Implementing the Resolution of the National Assembly Standing Committee, the Social Insurance of provinces and centrally run cities, based on the above regulations, confirms that business owners have paid compulsory social insurance before July 1, 2025 and resolves the arising social insurance regime in accordance with the provisions of law.
This regulation takes effect, meaning that nationwide, there will be about 3,539 owners of residential land owners who are eligible to be recorded as having paid compulsory social insurance for a period of time to serve as a basis for resolving social insurance regimes according to the provisions of the law on social insurance.
Previously, to resolve the issue of ensuring social insurance benefits for owners of residential land that have paid compulsory social insurance, Vietnam Social Insurance has sent documents to ministries and competent authorities to report and propose solutions for owners of residential land that have paid compulsory social insurance to ensure the rights of policy participants and beneficiaries.
