Clarifying the process, avoiding policy profiteering
According to the new Decree, investors of social housing projects will be allocated land without bidding, but must still ensure a clear and transparent process. Specifically, investors are allowed to determine their own selling prices and rental prices based on reasonable investment costs and standard profits according to legal regulations. Before implementation, these prices must be reviewed by a qualified unit and approved and made public on the Electronic Information Portal of the Provincial People's Committee and the Department of Construction.
An important innovation is the requirement that investors are not allowed to collect more than 95% of the contract value before the buyer is granted a Certificate of Land Use Rights and Property Attached to the Land. This regulation aims to protect people from the risk of delayed handover or projects that do not ensure the quality as committed.
In case after the official audit and appraisal, there is a difference compared to the price in the contract, the investor is forced to return the difference if the actual price is lower. On the contrary, if the price is higher, there will be no additional fees from buyers or tenants. This is a big step forward in transparency the process of buying and selling social housing, helping people feel secure when investing in this special type of housing.
Strengthening quality and progress control
To ensure the quality of the project, Decree 192/2025/ND-CP requires investors to fully implement quality control measures from the survey, design, construction to acceptance stages. Strict compliance with standards on fire prevention and fighting, environment, and construction safety is mandatory.
In case there are signs of quality violations or dangerous works discovered that do not ensure safety for residents, local authorities must take action to handle them promptly. Violating investors will be strictly handled, possibly the project may be suspended or the investment rights may be revoked.
In addition, the Decree also assigns the responsibility of the Government Inspectorate, ministries, branches, and provincial People's Committees to monitor, inspect, and strictly handle violations such as delays, poor quality construction, or policy profiteering.
When receiving feedback on violations in assigning investors, competent authorities must promptly organize inspections. If violations are detected, the investment decision will be revoked or suspended. This is to prevent the situation of "requesting - giving", lack of transparency in land allocation, and investor selection that has caused public outrage in recent times.

Removing bottlenecks in the process of renting and purchasing social housing not only helps people - especially low-income groups, workers, and laborers who are migrants - have easier access to stable housing, but also contributes to the effective implementation of social security goals.
