The above information is stated in the report of the Ho Chi Minh City Department of Construction sent to the Ho Chi Minh City People's Committee on the implementation of temporary management and use of a part of the roadway and sidewalk in Ho Chi Minh City.
The temporary management and exploitation of part of the roadway and sidewalk in Ho Chi Minh City is carried out on the basis of Resolution 15/2023/NQ-HDND, which stipulates specific toll rates for each area. From January 1, 2024, the city will officially apply fee collection.
Activities allowed to use part of the sidewalk, roadway and pay fees include: organizing cultural - sports events, festivals, parades; parking for cultural activities; business services, buying and selling goods; parking with fees; transporting household waste...
The fee ranges from 50,000 - 350,000 VND/m2/month for parking activities, and 20,000 - 100,000 VND/m2/month for other activities.
In May 2024, District 1 (old) was the first locality to pilot sidewalk rental as a service business location, then expanded to a number of other districts such as 3, 4, 8, 10, 12 (old).
By July 2025, the total amount of fees collected will reach about 8.5 billion VND.
According to the Department of Construction, after the merger, the management of sidewalk and road use outside of traffic purposes is still implemented according to the resolutions of the Ho Chi Minh City People's Council (formerly) as well as the People's Council of Ba Ria - Vung Tau province (formerly).
Currently, the Ho Chi Minh City Department of Construction is developing a Project for management and exploitation of sidewalks and roads to apply throughout the new Ho Chi Minh City.
However, the goal of developing the project is to effectively exploit and use the roadway and sidewalk for other traffic activities, but is not stipulated in Decree No. 165/2024/ND-CP (such as temporary use of sidewalks for business services, goods trading, temporary construction placement, etc.).
In addition, according to the Department of Construction, Decree 44/2024/ND-CP on management and exploitation of road traffic infrastructure assets is not suitable for the actual conditions of the city after the merger. Therefore, it is necessary to recommend the Ministry of Construction to review and advise the Government to amend this decree as a basis for developing the project.
The goal is to effectively exploit the sidewalk space for activities outside of traffic while still ensuring order, safety and urban aesthetics.
The Ho Chi Minh City Department of Construction proposed that the Ho Chi Minh City People's Committee abolish Decisions No. 32/2023/QD-UBND of the Ho Chi Minh City People's Committee (formerly) and Decision No. 45/2023/QD-UBND of the People's Committee of Ba Ria - Vung Tau province (formerly) according to regulations.
The Department of Construction also proposed that the Ho Chi Minh City People's Committee assign the unit to preside over and coordinate with the Department of Justice and the Department of Finance to review and submit to the Ho Chi Minh City People's Council to issue a resolution to replace Resolution 15/2023/NQ-HDND, Resolution 01/2018/NQ-HDND (amended and supplemented in 2020) of the Ho Chi Minh City People's Council (formerly) and Resolution 106/2019/NQ-HDND of the Ba Ria - Vung Tau Provincial People's Council (formerly).
At the same time, the Department of Construction was assigned to study and develop software to manage the collection of temporary tolls for road and sidewalk use. This software will ensure transparency, convenience in management and compliance with regulations on reception and implementation applied throughout Ho Chi Minh City.
