On April 30, the Staff Department - Dak Lak Provincial Police said that functional agencies had just had the results of the inspection of the capacity of a motorbike driven by a 12th grade male student in a traffic accident.
Accordingly, according to the Criminal Technical Department - Dak Lak Provincial Police, the actual cylinder capacity of the motorbike with license plate 47AB at the time of inspection was 155.7 cm3. Meanwhile, according to the technical specifications when leaving the factory, this vehicle uses a 4-stroke engine, with a capacity of 49.5 cm3 (commonly known as a 50cc vehicle).
According to functional agencies, to increase engine capacity, the method commonly used is "winding" (replacing longer transmission bars to increase piston stroke), combined with "barrel swirling" (convenient for expanding cylinder diameter and installing larger pistons).
Previously, at 11:20 am on April 15, Major N.Q. H, an officer of the patrol team of Krong Buk Traffic Police Station, was on patrol duty on National Highway 29, passing through the area of Pong Drang and Cu Pong communes, Dak Lak province.
At this time, Major N.Q. H discovered Mr. V.D. Q (residing in Cu Pong commune) driving a motorbike with license plate 47AB-325.78 traveling on the road.
Suspecting that Mr. Q showed signs of administrative violation, Major H did not follow the correct procedure of signaling to stop the vehicle for inspection but drove a specialized motorbike of the Traffic Police force to chase behind.
When reaching Km198+200 on National Highway 29, passing through Cu Yuot hamlet, Cu Pong commune, Mr. Q lost control of the steering wheel and rushed into the drainage ditch on the left side in the direction from National Highway 14 to Ea Kiet commune.
Discovering that Mr. Q and his motorbike had an accident, Major H, in his role as a traffic police officer, did not come to the scene to check and rescue but turned the car around and left in the opposite direction.
As a result, Mr. Q died during his emergency transfer from Hoa Binh General Hospital to Tay Nguyen Regional General Hospital.
Functional agencies determined that Mr. H's actions showed signs of constituting the crime of "Not rescuing people in a life-threatening condition", as stipulated in points a, b, clause 2, Article 132 of the Penal Code.
