On the Ministry of Construction Information Portal, citizen T.T.B.H reflected:
I would like to be allowed to answer about the issue that the dossier requires a notarized copy from the original. However, currently all dossiers submitted to the Department of Construction, my side is only allowed to stamp 2 original sets, and hand them all over to the investor, so it is all just a scan file.
Proving that the dossier for issuing a practicing certificate takes the prerequisite that there must be notarization, neither the design consultant nor the construction consultant has it".
From the above reality, citizens ask, can this be handled in which direction so that engineers are not entangled when encountering cases of needing a practicing certificate but lacking notarized records?
After research, the Department of Economics - Construction Investment Management (Ministry of Construction) has the following opinions:
The dossier requesting a new practicing certificate is specified in Clause 1, Article 88 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government.
Accordingly, the documents specified in points c, d, d, e of this clause must be certified copies or electronic copies certified according to regulations.
Details are as follows:
Diplomas issued by legal training institutions are suitable for the field and rank of professional certificates proposed for issuance; in cases where the diploma does not specify or does not clearly specify the training major, they must be accompanied by a transcript or appendix of the diploma to serve as a basis for inspection and evaluation (for diplomas issued by foreign training institutions, in cases where individuals are foreigners and Vietnamese people residing abroad, they must be consularly legalized copies and translations into Vietnamese that are notarized and certified in accordance with Vietnamese law; for the remaining cases, diplomas issued by foreign training institutions must be recognized by the Vietnamese education system).
The practicing certificate (if any) has been issued by a competent authority before in accordance with the time and scope of experience proof.
Decisions on assigning tasks (assigning tasks) of organizations to individuals or confirmation documents of legal representatives of investors and being responsible for the honesty of the content of confirmation of the tasks that individuals have completed according to the declaration content or documents of specialized construction agencies with content related to the experience of the declared individual; economic contracts and acceptance records of the declared tasks performed for cases of individuals practicing independently.
